Abstract
This paper provides an overview of the judicial dispute resolution system in Laos, focusing on court trial procedures and alternative dispute resolution (ADR) procedures, and analyzes the relevant laws, institutional structures, and operational status. Although Laos is politically a socialist one-party state, it has adopted the principles of a market economy and has actively pursued policies to attract foreign investment. As a result, disputes have arisen in various fields, including civil and commercial matters, labor, and investment. Alongside court judgments, a variety of alternative dispute resolution mechanisms are also operated in parallel as means of resolving such disputes. The judicial system of Laos is based on a three-tier structure. Civil litigation procedures in Laos have a stronger inquisitorial nature compared to those in Korea and adopt a mandatory pre-trial conciliation system, meaning that conciliation procedures must be undertaken before a lawsuit can be filed. As an ADR mechanism, the Law on Economic Dispute Resolution, which is particularly used by foreign investors, regulates conciliation and arbitration procedures for disputes arising from economic activities, such as breach of contract, non-performance of obligations, and investment-related disputes. It codifies the principles of voluntariness, fairness, promptness, and equality. Settlement agreements and arbitral awards concluded in accordance with the dispute resolution procedures under this law may be subject to compulsory enforcement pursuant to the Law on Enforcement of Judgments if the parties do not voluntarily comply. The Village Mediation Committee is a non-judicial dispute resolution body at the village level, which is the lowest administrative unit, and has jurisdiction over civil, commercial, family, labor, and environmental cases, as well as certain minor criminal cases. It is characterized by community-based mediation and the application of customary law. The labor dispute resolution system, which deals with disputes between labor and management, applies to both individual and collective disputes, as well as rights-based and interest-based disputes. It seeks resolution through stages including agreement, administrative procedures, the Labor Dispute Resolution Committee, and the courts. Meanwhile, the recently amended Law on Enforcement of Judgments stipulates the compulsory enforcement procedures for the outcomes of judgments and other dispute resolution results. It details the processes for property seizure, sale, debt recovery, and execution of enforcement orders. Thus, the dispute resolution system in Laos operates judicial procedures alongside a variety of non-judicial dispute resolution mechanisms, and it has established a relatively clear framework in terms of legal provisions and procedural design. By organizing these institutional structures and procedures, this paper aims to enhance understanding of dispute resolution pathways in Laos and to provide basic legal and institutional resources that can be utilized by domestic companies and investors.
