Abstract
The donation participation rate of South Korean citizens aged 13 and older decreased from 36.4% in 2011 to 23.7% in 2023, with the willingness to donate in 2023 also remaining low at 38.8%. Despite various opinions on the reasons for this decline, the limitations of the legal and institutional framework are cited as a major cause. In response, the 21st National Assembly engaged in extensive discussions on the revision of the Donations Act, which was officially amended on January 30, 2024, as the “Act on the Collection and Use of Donations and the Promotion of Donation Culture.” This amendment marks the first revision of the act’s title in 18 years since the transition from a permit-based to a registration-based system in 2006. However, the changes made are considered limited compared to the diverse legislative demands raised by civil society and the National Assembly during that time. This study examines the amendment history of the Donations Act, tracing back to the “Regulation on the Collection of Donations” established during the Japanese colonial period, as well as various legislative attempts and issues. The key aspects of the 2024 revised Donations Act are also analyzed. The revised law reflects the evolving donation environment by defining donations, specifying the responsibilities for promoting a donation culture, and introducing provisions for fundraising through information and communication networks. However, it is difficult to expect a significant change in the scale of fundraising as regulations on the use of donations, such as fund raising expenses that are difficult to apply in actual fundraising sites, remain in place. Despite these limitations, the amendment is significant in shifting the perspective from regulatory control to the promotion of a positive donation culture. Moving forward, it is necessary to ease uniformly applied regulations, ensure sufficient information is provided to donors, and establish a structure where legal responsibility is imposed when funds are used differently from disclosed information, thereby advancing toward enhancing both the autonomy and accountability of fundraising.
