Abstract

This paper conducts a comparative legal analysis of how the rights of nature have been judicially recognized and applied in two landmark cases: the Los Cedros Reserve case in Ecuador and the Atrato River case in Colombia. Both cases represent groundbreaking developments in ecological constitutionalism, where nature is no longer seen merely as a resource or object of regulation but as an autonomous subject of legal rights. In the Los Cedros case, the Ecuadorian Constitutional Court directly invoked Article 71 of the 2008 Constitution, which explicitly grants legal rights to nature, and ordered the suspension of mining activities in a protected forest area to preserve biodiversity and ecological balance. In contrast, the Colombian Constitutional Court, although lacking explicit constitutional provisions on nature’s rights, interpreted existing rights such as the right to a healthy environment, human dignity, and indigenous autonomy, and developed the legal concept of biocultural rights to protect both the river ecosystem and the indigenous communities dependent on it. Both courts applied the precautionary principle, a cornerstone of international environmental law, by requiring preventive measures even in situations of scientific uncertainty. They also implemented a reversal of the burden of proof, obligating the state and private actors to demonstrate the environmental harmlessness of their activities. This study systematically compares these judicial elements with the components of the precautionary principle as found in international treaties (e.g., the Rio Declaration, CBD, UNFCCC), ICJ and ITLOS case law, and legal scholarship, identifying points of convergence and divergence. The findings suggest that even in countries without explicit constitutional provisions on nature’s rights, courts and subnational governments can operationalize these principles through creative legal interpretation and localized ordinances. The study concludes that such jurisprudence can serve as a foundation for rights-based environmental governance, offering strategic insights for Korea and other jurisdictions seeking to transition from anthropocentric environmental regulation toward a more ecological, participatory, and preventive legal paradigm.
