Abstract

Recent U.S. court decisions on the use of copyrighted works in AI model training have provided critical insights into the application of the fair use doctrine. The rulings in Bartz v. Anthropic, Kadrey v. Meta, and Thomson Reuters v. ROSS highlight the complex legal landscape where AI innovation and creator rights intersect. These cases, though seemingly contradictory, offer a unified set of principles that will guide future litigation. The core takeaway is that a distinction must be made between generative AI and non-generative AI. The courts found the training of generative AI to be highly transformative, as it uses copyrighted works to create something new with a different purpose than the original. In contrast, the use of a non-generative AI was deemed non-transformative because it served the same purpose as the original copyrighted work. Another pivotal factor is market harm. The rulings underscore that a plaintiff’s ability to win a copyright infringement case hinges on demonstrating concrete harm to the market for their work. In Kadrey, in particular, it showed that even with strong arguments, a lack of evidence for market dilution—the flooding of the market with competing AI-generated works— can be a decisive factor in a defendant’s favor. Finally, the legality of data acquisition is paramount. In Bartz, it clear that a fair use defense is unlikely to succeed if the training data was obtained through piracy. The transformative nature of the AI model does not justify the initial act of unlawfully acquiring the copyrighted work. The legal landscape is still evolving, but these early decisions lay the foundation for a more defined framework. As AI technology continues to advance, the courts will likely continue to balance the need to foster innovation with the fundamental right of creators to control their work and be fairly compensated. To this end, through systematic analysis centered on the legal principles of fair use, it will be able to serve as a useful reference material that can be referenced in future copyright infringement disputes related to artificial intelligence in Korea, thereby contributing to achieving the ultimate purpose of copyright law.
