유럽연합 공동이민망명정책의 발전과 배타성 연구-유럽정체성과 이민의 안보화를 중심으로

초록

유럽연합은 사람의 이동에 대해 내적으로는 완전한 자유주의를 추구하지만 외적으로는 배타성을 가지는 현실주의적인 정책을 취하고 있다. 본 연구는 ‘유럽의 요새화’를 형성하고 있다고 비판받고 있는 유럽연합의 공동이민망명정책이 왜, 그리고 어떻게 배타적인 정책이 되었는가를 살핀다. 본 연구자는 이러한 공동이민망명정책의 초국가적 제도화와 ‘포함’과 ‘배제’의 성격이 유럽의 정체성 유지를 위한 ‘유럽시민권’과 이민의 안보화에 따른 ‘자유, 안전, 정의의 공간’ 형성이라는 필요성으로부터 나온다고 본다. ‘유럽시민권’은 유럽 시민들에게 통합의 혜택을 돌려주려는 필요뿐만 아니라 이민자들의 대대적인 유입에 의한 정체성의 위협에 대한 대응으로 이해할 수 있다. 시민의 권리 보장을 위한 ‘유럽시민권’ 제도를 통해서 이를 가진 유럽인과 가지지 못한 비유럽인들의 권리는 명백한 차이를 보인다. 유럽 시민들에게 자유롭고 안전한 공간을 보장해 준다는 ‘자유, 안전, 정의의 공간’은 ‘유럽시민권’과 연계되어 시민권을 가지지 못한 사람들은 그러한 권리를 누리지 못하는 결과를 가져온다. 이를 통해 유럽연합의 공동이민망명정책을 구성하는 망명정책, 국경통제 및 비자정책, 이민정책 들은 비유럽인들이 진입하기 어려운 배타적인 정책이 되었다. 따라서 유럽연합의 공동이민망명정책은 영토개념의 탈피와 민족의 극복을 통한 평화로운 공동체 구현이라는 기본 원칙이 왜곡되고 있다.

Abstract

For moving of persons, European Union is conducting a realistic policy which is characterized by exclusivity, while it pursues a complete liberalism within the space of the EU. This study examines why and how has become exclusive the EU’s common immigration and asylum policy that has being blamed for constructing ‘Fortress Europe’. We see that the supranational institutionalization and the feature of ‘inclusion’ and ‘exclusion’ of the common immigration and asylum policy of the European Union derive from the necessity for forming ‘European Citizenship’ and ‘an area of freedom, security and justice’. ‘European Citizenship’ is a response not only to the necessity for giving the benefits of european integration back to european citizens, but also to the threat to european identity to be weakened by the immense inflow of immigrants. ‘European Citizenship’, to guarantee the european citizens’ right, distinguishes europeans who has it from outsiders. ‘An area of freedom, security and justice’, to ensure a free and secure space to european citizens, brings about losing of fundamental rights by the people who have not ‘European Citizenship’. Through this logic, the EU’s common immigration and asylum policies, for example the asylum policy, border control and visa policy and immigration policy, have become exclusive policy.
