Abstract

The European Union(EU) often positions itself as a global regulator. The EU has a distinctive regulatory approach that differentiates it from other major regulatory powers. Compared to China's state-driven regulatory approach and the United States' market-driven approach, the EU's regulatory method is a rights-based model. In other words, the European rights-based model pursues the protection of fundamental rights such as human dignity, data privacy, and democracy. To this end, the EU holds the rapidly changing digital technology sector accountable and regulates it in ways that do not harm European citizens. While regulations on the technology sector, like all other EU regulations, target the European market, they often extend beyond European borders. That is, EU regulations apply to all types of actors providing products or services to the European market, regardless of whether they are based in Europe. In this context, Anu Bradford explains the EU's importance in setting global rules and standards through the term "Brussels effect." Currently, the EU is actively working to set standards in various areas, from attempts to strengthen regulations on large digital platforms to the world's first legislation for AI regulation, new rules on Data Governance, and Cybersecurity. However, there are also opinions that this rights-based approach to digital regulation hinders innovation and weakens EU competitiveness. Therefore, this paper aims to discuss what rights and values the European rights-based model pursues, and whether this regulatory approach hinders technological innovation and development. For these research objectives, this paper is structured as follows: Chapter II examines what the EU's rights-based model and the Brussels effect are, focusing on Bradford's discussion. Chapter III analyzes what normative values the EU pursues in the digital regulatory sphere. Chapter IV considers whether this European rights-based model hinders innovation or not.
