이 글은 최근 북한의 노동법제 변화에 관한 것이다. 북한은 북한 자국 내 기업소 등과 근로자간의 노동관계에 관한 법으로 사회주의로동법 및 외국인투자기업, 근로자간의 노동관계에 관한 제반 법률 규정을 갖추어 이원화된 노동법제를 갖고 있다. 후자의 경우에는 외국인투자기업의 종류나 경제특구의 위치 등에 따라 각각 개별적인 노동규정을 정비해 두고 필요에 따라 수시로 개정하는 모습을 보여 왔지만, 전자의 경우에는 거의 변화 없이 30년 넘게 그 형태와 내용을 유지했다. 그런데 최근 이러한 모습에 큰 변화가 있었다. 노동보호법과 노동정량법의 제정이 그것이다. 이 글에서는 사회주의로동법을 수정․보충하는 역할을 하는 한편, 외국인투자기업에게도 영향을 미치게 될 노동보호법과 노동정량법을 사회주의로동법과 비교․검토한다. 이를 통해 이 두 법이 북한 사회에서 갖는 의미와, 북한에서 조업 중인 남한 기업에 미칠 영향에 대하여 이해할 수 있을 것이다.
Abstract
This paper is about recent change in the labor law system of DPRK. The labor law system of DPRK is dualistic, consisting of the Socialist Labor Law, the legal system on the labor relations between public enterprises within DPRK and workers, and various laws and regulations on the labor relations between the foreign investment enterprises and workers. As to the latter, individual labor regulations had been prepared depending on the sorts of the foreign investment enterprises and the locations of special economic zones and has been amended on occasion, but as to the former, the legal system has been almost unchanged and maintains its form and contents for over 30 years. This paper examines the Labor Protection Law and the Labor Measurement Law, amending and supplementing the Socialist Labor Law and having prospects to affect the foreign investment enterprises and compares them with the Socialist Labor Law. This examination would help understanding of the meaning of those laws in the society of DPRK and their influence on the enterprises of ROK operating in DPRK.
