Abstract

In addition to criticism whether the numerous opinions of the people are accurately and faithfully converted to legislation and how political alienation of people occurring in legislation process can be reduced in connection with legislative action in representative democracy, emphasis is put on adoption of direct democracy system and people's participation in legislation process as a measure to supplement it. Legislation process is not a unilateral process of national policy or decision-making but it is a conversion of people's opinion to the form of legislation and therefore, it is necessary to review various and actual plans from the aspect that people's opinion has to be fully converged and reflected on the legislation process. Thus, this article first investigates how lawmaking by the people as a direct democracy is embodied mainly in Switzerland and USA. In particular, as for USA, legislation is enacted by the assembly under a thorough representative system in the federal level and therefore, enactment or revision of legislation through people's initiative or referendum but a direct democratic system coexists with a representative system in the state level and also, people's direct participation in the legislation process is made by people's initiative and referendum. Second, this article intends to look into criticism and validity of lawmaking by the people. For this, it reviews lack of sufficient deliberation and control system in legislation process, limitation of decision made by simple yeas and nays, and problems and criticism of insufficiency of minority protection, Third, as for our country which only accepts referendum of the Constitution but does not accept people's initiative and referendum, it reviews the problem of People's actual participation in legislation. Emphasis on lawmaking by the people as a direct democracy has necessity of legislation directly made by people. However, it still has a meaning to emphasize people's participation in legislation for people themselves because the assemblies in most countries do not enact legislation required by people in the legislation process pursuant to principle of the representative system but they make legislation isolated from people. In addition, increase of academic interest and study provides an opportunity to have abundant understanding about dynamics of the whole legislative structure.
