본 연구의 목적은 장애인거주시설 거주기준의 대안에 관해 고찰하는 것이다. 거주 기준에 관한 구체적인 내용이 장애인복지법 시행규칙에 규정되어 있으므로 동 규칙의 개선 방안을 검토하였다. 특히, 거주의 질에 직접적인 영향을 미치는 기준을 검토하였으며, 이를 위해 1인당 시설 면적, 1실당 적정한 거주인원 및 거주 공간 및 설비에 관한 사항을 집중적으로 고찰하였다. 그동안 장애인거주시설의 기준 상 부지를 포함한 총면적이 주요한 기준이어서, 총 공간은 넓지만 거주를 위한 공간은 협소하다는 지적을 받아왔다. 이와 더불어, 전통적으로 장애인 거주시설 설치에 집단적 형태의 모델을 택하면서 직접적인 거주 공간에 대한 고려가 미흡하여 개선은 요원한 상황이었다. 이러한 공간 설정은 장애인거주시설에서 생활하는 장애인이 인간적인 삶을 영위하는 데 상당한 제약요소로 작용하는 등 비인간적 기준이라는 비판이 지속되어 왔다. 이러한 문제 인식아래 이번 연구에서는 개별적이고 인간적인 삶이 가능한 대안을 모색하였으며, 종래 장애인거주시설의 1인당 면적 산출방식과 총면적 기준에서 벗어나, 주거의 기본 공간을 계획하고 제도화하는 방안에 초점을 두었으며, 현실적인 삶에 있어서의 주거의 쾌적성을 담보하고자 하였다. 집단적 수용형태의 거주시설이 가지고 있는 관련 공간 규정을 정비하고 거주설비에 관한 사항을 보다 발전적으로 검토하는 것도 본 연구의 주제였다. 장애인거주시설과 거주 장애인의 개별적이고 특수한 상황을 고려하지 않고 획일적인 설비기준을 요구하는 것을 지양하고, 핵심적이고 기본적인 거주 공간 외에는 시설의 목적과 방향에 따라 장애인거주시설의 관련 공간을 탄력적으로 배치하고 운영할 수 있도록 새로운 설비규정을 제안하였다.
Abstract
This study aims to explore the development of living environments of facilities for people with disabilities, focusing on the revision of act on the welfare for people with disabilities. For this, it suggests that adequate floor spaces per person and living conditions need to be established for the people. It is said that the spaces for them is not sufficient to enjoy decent life as the facilities to be set models of housing for big groups do not give a decent life. To overcome this problem, this study tries to produce adequate living conditions, Furthermore, this study investigates the revision of the Act regarding spaces and convenient facilities regarding minimum standards for living facilities. Thus, It suggests that it needs to run related spaces by self-control of the organizations except for the must living spaces. It means that the Act will be enacted to consider people’s environments, rather than the uniformity for all facilities. It will contribute to developing the living conditions of people with disabilities and helping independent living in a given community they belong to.
