현대 대의민주주의 제도 연구-직접민주주의 요소인 국민투표제도의 재인식을 중심으로-

역사적으로 볼 때 근대국가의 기본원리로 정착된 대의민주주의제도는 통치구조상 치자와 피치자를 구분하고 정책결정권과 기관구성권을 분리하여 선거로 선출되는 국민의 대표자를 통해 국민주권원리를 실현하는 기본구조를 가지고 있다. 그러나, 권력분립 원리의 형식화와 행정권의 강화, 사회의 다원화에 따른 대표성의 약화, 국민의 의사와 대의기관의 결정 사이에 보이는 현실적인 괴리에 대한 문제의식, 국정에 대한 국민적 참여욕구의 증대 등과 함께 현대 대의민주주의제도는 변화를 요구받고 있으며, 이러한 변화의 상황에서 직접민주주의제도가 대의제의 약점을 일정부분 보완해 주는 기능을 가지는 것이 주목을 받고 있다. 어떤 정치제도도 시대와 환경을 떠나서 변화되지 않고 완전하게 유지될 수는 없으므로 대의민주주의의 현대적 위기로 제기되는 ‘대의제 원리의 실패’에 대한 보완 또는 수정 원리로서 직접민주주의제도의 일정부분 접목은 21세기에 새롭게 요구되고 있다. 또한, 현대 사회의 일반 시민과주권자의 교육수준이 향상되고 이에 따른 정치에 대한 관심 고조, TV 등 대중매체의 발달과 정보화시대의 도래는 국민 여론 형성을 이끌고 보다 더 많은 국민의 직접 정치 참여 기회를 현실 속에 자리 잡게 하였다. 이를 바탕으로 본 연구에서는 민의를 수렴하고 이를 실천하는데 있어서 현실적인 문제점에 봉착한 대의민주주의제도를 직접민주주의제도의 대표 요소인 국민투표제도로서 수정 보완할 수 있는가에 집중하였다. 과연 직접민주주의는 이념에 불과하고 실현 불가능한 것인지에 대하여 분석하고 현실에 접목이 가능하다면 현대 국가의 통치원리로 주류를 이루고 있는 대의민주주의의 현실에서 상호 공존이 어떻게 가능하며 그 범위는 어떻게 설정할 것인가에 관해서도 고찰하였다.
Abstract
Historically, the representative democracy system established as the basic principle of modern state has a basic structure that realizes the principle of national sovereignty through the representatives of the people elected by election by separating the right of policy decision and the right of organization by distinguishing the ruler and the peach in the governance structure. However, with the formalization of the principle of power division, the strengthening of administrative authority, the weakening of representation due to the diversification of society, the awareness of the problem about the realistic gap between the will of the people and the decision of the agency, and the increase of the national desire for participation in the state, the modern representative democracy system is required to change. Since no political system can be maintained without changing from the times and environment, it is required to combine some of the direct democratic system as a supplementary or modified principle for the failure of the principle of the representative democracy, which is raised as a modern crisis of representative democracy, in the 21st century. In addition, the education level of ordinary citizens and sovereigns in modern society has improved, and the interest in politics has been heightened, and the development of mass media such as TV and the advent of the information age led to the formation of public opinion and established more people's opportunities for direct political participation in reality. Based on this, this study focused on whether the representative democracy system, which has faced realistic problems in collecting and practicing the people's opinion, can be revised and supplemented as a referendum system, which is a representative element of the direct democracy system.If it is possible to apply it to the reality, how can mutual coexistence be possible and how to set the scope in the reality of representative democracy which is the main principle of the modern state.
