망이용대가에 관한 경제학적 고찰

본 논문은 SKB와 넷플릭스의 사례를 중심으로 ISP와 CP 간 망이용대가 도입여부에관련되는 다양한 효과를 비판적으로 검토하면서 적절한 정책방향을 제시한다. 망이용대가, 즉, 착신료의 도입은 비차별성과 개방성을 추구하는 망중립성의 정신과 상충되며, 컨텐트의 발전을 위축시킬 수 있으며, 망 투자를 촉진하는 효과는 모호하다. 망이용대가에 관한 정책 제언을 제시한다. 첫째, 일정 규모 이상의 대형CP의 경우에는 가급적 당사자간 자율협상에 맡기며, 일정 규모 이하의 CP에 대해서는 착신료의부과를 금지하는 것을 제안한다. 둘째, ISP간 상호정산 제도는 폐기하는 것이 타당하다. 셋째, 정부가 제로프라이스 규칙을 파기하거나 파기되는 것을 촉진하려는 정책을추진할 때에는 다양한 파급효과를 충분히 그리고 면밀하게 검토해야 한다. 넷째, 정부가 착신료에 관한 규율에 문제가 있다고 판단한다면, 글로벌 표준에 관한 국제적논의에 참여하여 그 표준을 개선하도록 노력해야 하며, 단독으로 우리나라만의 특이한제도를 만드는 것은 지양해야 한다.
Abstract
This study presents policy directions by critically examining the various effects of network usage fees, focusing on the case of SKB and Netflix. Termination fees conflict with the spirit of network neutrality, which pursues non-discrimination and openness, may discourage the development of the content industry, and has an ambiguous effect on network investment. We provide policy recommendations regarding network usage fees. First, in the case of large CPs above a specific size, we suggest leaving it to negotiation between the parties and prohibiting the imposition of fees for CPs below a certain size. Second, it is reasonable to abolish the current settlement rule between ISPs. Third, when the government pursues a policy to destroy or promote the destruction of the zero price rule, it must thoroughly and carefully review various effects. Finally, if the government determines that there is a problem with the regulations regarding termination fees, it should participate in international discussions on global standards to improve the standards and avoid creating unique rules.
