디지털 경제 및 지식재산 경제 시대로 접어들면서 다양한 분야의 정보들을 디지털화, 네트워크화하여 효율적으로 관리하려는 시도가 이루어지고 있다. 그중에서도 산업재산정보는 특허, 상표, 디자인 등을 창출, 보호, 활용하는 과정에서 수집·가공된 자료로서 권리 부여 대상에 대한 상세한 설명뿐만 아니라 발명자, 권리자, 출원 분야, 소송 여부 등 부가적 정보까지 포함하고 있어 효율적 연구개발(R&D)을 하는 데 중요한 자원이 된다. 세계 주요 국가들은 이처럼 디지털 전환 및 지식재산 분야의 중요성을 인식하고 새로운 패러다임에서 경쟁적 우위를 확보하고자 다양한 정책 및 법 제도를 추진하고 있다. 우리나라도 최근 「데이터 산업진층 및 이용촉진에 관한 기본법」, 「산업기술혁신 촉진법」 등을 제정하고, 2022년 2월에는 10개 부처가 모여 ‘제1회 범부처 지식재산 보호정책 협의회’를 개최하는 등 정부가 관심을 집중하고 있다. 다만, 산업재산정보 규율에 대해서는 아직 별도의 법률이 마련되지 않은 상태이다. 그런데 이와 관련해서 현행법과 같이「발명진흥법」 일부 조항으로 다루는 것은 법체계 정합성 측면 뿐만 아니라 4차산업혁명 시대에 대응하기에는 미흡하다는 비판이 제기되었고, 2021년 11월 「산업재산정보의 관리 및 활용 촉진에 관한 법률(안)」이 발의되어 현재 국회에 계류 중이다. 산업재산정보를 체계적·전문적으로 규율할 경우 해당 분야의 정보를 신속하고 유기적으로 파악할 수 있어, 융합 분야의 연구가 활성화되고 분쟁 대응이나 신기술 개발 전략 수립에 있어서도 매우 유용할 것으로 예측된다. 다만, 최근 유사한 영역의 법률이 잇따라 제정됨으로써 기존 법률 또는 새로운 법 사이에 법 적용의 혼란이나 충돌이 발생하지 않을까 하는 우려가 존재한다. 이와 관련하여 본 논문에서는 「산업재산정보의 관리 및 활용 촉진에 관한 법률(안)」의 제정 배경, 주요 내용, 그리고 타법과의 조화 및 해석 기준에 대해 살펴보았다.
Abstract
As we enter the era of digital economy and intellectual property economy, attempts are being made to digitize and network information in various fields to efficiently manage it. Among them, industrial property information is data collected and processed in the process of creating, protecting, and utilizing patents, trademarks, and designs. It is an important resource for efficient R&D. Recognizing the importance of digital transformation and intellectual property, major countries around the world are promoting various policies and legal systems to secure a competitive edge in a new paradigm. Korea also recently enacted the 「Basic Act on the Promotion of Data Industry Promotion and Utilization」 and 「Industrial Technology Innovation Promotion Act」, and in February 2022, 10 ministries gathered to hold the '1st Inter-ministerial Intellectual Property Protection Policy Council' The government is paying attention. However, a separate law has not yet been prepared for the regulation of industrial property information. However, in this regard, criticism has been raised that dealing with some provisions of the 「Invention Promotion Act」 like the current law is insufficient to respond to the era of the 4th industrial revolution as well as in terms of consistency of the legal system. A law (draft) was proposed and is currently pending in the National Assembly. When industrial property information is systematically and professionally regulated, information in the relevant field can be grasped quickly and organically, and it is expected that research in the convergence field will be activated and will be very useful in responding to disputes or establishing new technology development strategies. However, there is a concern that, as laws in similar fields have been recently enacted one after another, confusion or conflict in the application of laws may occur between existing laws or new laws. In this regard, this paper examines the background, main contents, and standards for harmonization and interpretation with other laws of the 「Act on Promotion of Management and Utilization of Industrial Property Information (draft)」.
