사물인터넷(IoT)과 빅데이터(Big Data)는 지난 몇 년 동안 정보통신기술(ICT) 분야에서 중요한 역할을 해왔고, 4차 산업혁명 시대에서 정보통신기술(ICT) 분야의 새로운 패러다임에서도 중요한 역할을 할 것으로 예상된다. 모든 사물이 인터넷에 접속된 사물인터넷(IoT) 시대에서 사물로부터 자동집적된 빅데이터가 높은 기술적 ·경제적 가치를 가짐으로써 커다란 주목을 받고 있다. 이처럼 사물인터넷, 빅데이터 등 정보통신기술과의 융합을 통한 경제·사회 전반의 혁신적 변화에 맞춰 우리 지적재산법제의 나아갈 방향성을 모색할 시점에 서 있다. 그러나 그렇게 자동집적된 빅데이터가 지적재산법에서의 법적 위치가 무엇인지는 반드시 명확하지 않다. 지적재산과 관련된 빅데이터의 보호 쟁점에 대해서는, 지적재산권법(저작권법, 특허법과 부정경쟁방지법을 포함한 산업재산권법)과 민법(계약법과 불법행위법)으로 나누어 검토해 볼 수 있다. 다만 현행법에서는 그 보호의 한계도 있기 때문에 각 법률상 입법론 내지 개정방안을 검토해야 하는 과제가 주어져 있다. 이 글에서는 빅데이터의 보호와 관련하여 지적재산법을 중심으로 그 보호방안과 과제를 살펴보고 빅데이터의 이용활성화를 위한 입법론에 대해 각 개별법상에서 검토를 시도해 보고자 한다.
Abstract
The Internet of Things (IoT) and Big Data have played an important role in the field of Information and Communication Technology (ICT) throughout the last few years and are expected to play a significant role on the ICT’s new paradigm in the era of the Fourth Industrial Revolution as well. In the Internet of Things(IoT), where all things are connected to the Internet, Big Data, which is automatically collected from objects, is attracting great attention because of its high technical and economic value. In this way, we are looking at the direction of the intellectual property legislation system in accordance with the innovative changes in the whole economy and society through convergence with information and communication technologies such as Internet of things and big data. However, it is not necessarily clear what is the legal status of the big data collected automatically in the intellectual property law. Regarding the issues of protecting big data related to intellectual property, we can examine the protection of intellectual property laws (copyright law, industrial property law including patent law and unfair competition law) and civil law (contract law and tort law system). However, there are limitations to the protection of the existing law, so there is a problem to examine legislation and amendment in each law. In this article, we will examine the protection measures and issues related to the protection of big data, focusing on the intellectual property law, and try to examine each law on the legislation to activate the use of Big Data.
