‘종주권’이라는 말은 인문 사회 과학의 여러 분야에서 중국이 그 주변의 조공책봉(朝 貢冊封) 관계에 있는 국가나 군장(君長)에 대해 행사한 전통적 권위의 의미로 널리 사 용되지만, 실제로는 19세기 말 이전에는 존재하지 않던 것이었다. 이 글에서는 당시 일본 신문의 논설, 역사서, 국제법 서적의 검토를 통해 이 개념이 1880년대 일본 사 회에서 처음 출현한 사실을 규명했다. 특히 1886~1887년 사이 조선 관계 논설에서 ‘종주권’이라는 용어가 집중적으로 등장한 사실에 주목해, 당시 청의 조선 정책 변화 의 본질과 그에 대한 일본 사회의 인식이 그것에 미친 영향을 분석했다. 이를 통해 ‘종주권’은 청이 스스로 주장한 모종의 국제적 권리도, 동아시아의 전통적 국제 질서 의 규범도 아니었으며, 일본 사회에서 이를 관조(觀照)하는 가운데 창조한 인식상의 산물에 지나지 않았음을 주장했다. 이후 ‘종주권’은 역사서와 국제법 서적에서 서구의 ‘suzerainty’ 개념의 번역어로도 사용되기 시작했다. 이 말이 본격적으로 유행한 것은 러일 전쟁을 전후한 시점으로 서, 그 의미는 일본 제국이 한반도에서 차지한 정치적 우월성과 보호국이라는 법적 지위를 포괄하는 것이었다. 이처럼 불과 20여 년 만에 일본 제국이 스스로 ‘종주권’ 의 주체를 자임할 수 있었던 지성사적 배경으로서, 제2차 보어 전쟁을 전후한 대영 제국의 국가 실행과 ‘suzerainty’의 의미 변화, 국제법상 실정법주의의 유행, 제국주 의 이론의 확산을 검토했다.
Abstract
The term ‘Jongjukwon (宗主權, suzerainty)’ is widely used across various fields in the humanities and social sciences to describe the traditional authority that China exercised over tributary states and vassal rulers. This paper argues that China’s relations with its neighbors were not understood in this way, however, and that the concept of ‘Jongjukwon’ did not actually exist prior to the late 19th century. Newspaper editorials, historical texts, and publications on inter- national law are used to trace the emergence of the concept in Japanese society during the 1880s. In 1886-7, the term ‘Jongjukwon’ became very much more common in editorials related to Joseon, as a consequence of changes in Qing China’s policies, and Japanese perceptions of these developments, which influenced its adoption. This study argues that Jongjukwon was not a claim asserted by Qing China to international rights, and neither was it a normative principle of East Asia’s traditional international order. Rather, it was an intellectual construct shaped by contemporary Japanese observations and interpretations. From the late 1880s, ‘Jongjukwon’ began to appear sporadically in some historical texts and international law writings as a translation of the English term ‘suzerainty.’ Its widespread adoption, however, occurred around the time of the Russo-Japanese War, when it came to encompass Japan’s putative political superiority and the legal status of Korea as a protectorate. This article examines the intellectual background which enabled the transformation from Qing Jongjukwon into Japanese Jongjukwon within just two decades. Key factors examined include shifts in the British Empire’s legal and administrative practices, the redefinition of ‘suzerainty’ around the Second Boer War, the rise of positivism in international law, and the spread of imperialist theories.
