근대일본의 ‘주체’ 개념에 관해, 지금까지 그 철학적 의미는 논의되어 왔으나 정치법학적 의미에 관한 검토는 거의 이루어진 바가 없다. 그런데 근대일본에서‘주체’ 개념의 형성과정을 살펴보면, ‘subject, sujet, Subjekt’의 번역어로 초기에‘주관’이 등장했으나 곧 철학영역에서 ‘주체’의 용어가 부상했으며, 이후 헌법 논쟁을 통해 ‘통치권의 주체’라는 강력한 의미장 속에서 ‘주체’의 의미가 성립되었다는 특징을 발견할 수 있다. 이 점에 주목하여 본고는, 1889년 「대일본제국헌법」 조문과 관련하여, 천황주권설파의 헌법해석론에서 ‘통치권의 주체’로서 ‘국가’와‘천황’을 어떻게 위치시켰는가를 살펴봄으로써, 그 안에서 법리와 국체사상 그리고 신도사상이 결합하여 잡종적인 ‘주체’ 개념을 형성해 간 과정을 검토한 것이다. 이 작업을 통해, 이렇게 착종된 ‘천황-국가적 주체’의 의미가 근대일본의 ‘주체’ 개념 형성에 영향력을 가지고 자장을 형성하고 있었음을 확인할 수 있다. 더나아가 이 작업은, 제국-식민지 사이에 가로놓여 있는 문제로서 ‘주체’ 개념을생각하는 데 일정한 시사를 줄 수 있으리라 기대한다
Abstract
.For the concept of ‘主體’ (Shutai ) in modern Japan, its philosophical meaning has been actively discussed, but its political and legal meaning has received far less attention. The formation process of the ‘主體’ concept in modern Japan was complex : it first appeared in the term of ‘主觀’ as a translation of ‘subject,’ ‘sujet,’ or ‘Subjekt,’ but soon acquired the sense of ‘holder of a right (and duty),’ and subsequently, during the constitutional debates, the meaning of ‘only holder of sovereignty’ emerged, which was then taken to mean ‘emperor’s body,’ and hence the meanings of ‘God’s body,’ or ‘substance,’ or ‘essence’ as ‘God’s Way’ were also established. This paper explores the interpretations of emperor-sovereignty theorists with regard to the Constitution of the Empire of Japan, proclaimed in 1889 : the key issue being whether ‘the Shutai of ruling and governing’ was ‘the emperor’ or ‘the state.’ The bizarre concept of ‘Subject’ (主體) arose through an inter- mingling of legal theory, kokutai ideology, and Shintoism. This analysis confirms that the meanings of the ‘主體’ concept articulated by the emperor-sovereignty theorists had a considerable influence on the general understanding of the ‘Subject’ concept in imperial Japan.
