대학내 교수성희롱의 성차별적 특징: 세 대학 사례를 중심으로

이 연구는 교수성희롱이 어떻게 단순히 잘못된/서투른 성적 표현이 아니라 성차별이 되며 대학내 여성의 주변적 위치를 지속시키는 기제로 작용하는지 이해하기 위해 시도되었다. 분석은 세 대학에서 발생한 교수성희롱을 중심으로 심층면접과 관련 자료에 근거해 사건이 전개되는 과정에 초점을 맞춘 후, 각 단계마다 사건관련자들이 성희롱의 의미를 구성하는 방식을 해석하고 그 사회적 맥락을 드러내는 형식으로 이루어졌다. 사례에서 성희롱 피해자는 사건이 전개되는 동안 학교생활 전반을 통해 지속적으로 피해를 경험함으로써 이것이 성차별의 문제임을 입증하고 있었으나 학생과 교수의 차등적 권력관계가 매 단계마다 성희롱을 성차별로 보지 못하게 하는 다양한 논리를 구성하는데 영향력을 행사하였다. 사례는 대학내 성평등 체계가 마련되어있지 않은 상황일 때 성희롱은 성차별과 무관한 것으로 인지되고 그 결과 성희롱은 현재의 성별 위계 구조를 유지, 강화시키는 효과를 낳음을 보여주었다.

Abstract

This work attempts to analyze why sexual harassments by professors should be characterized as the sex discrimination rather than simple wrong/awkward sexual expressions, thereby, serving as the tools for the continuation of women's subordinate status on campus. According to the theoretical arguments discussed in this work, it is generally agreed that the sexual harassment is a case of power abuse and there should be stronger regulations on the Quid Pro Quo harassment where the institutional and patriarchal powers are superimposed. However, there are still controversies on whether the hostile environment harassment should be regulated by the law by extending the conceptual framework of the patriarchal power and/or whether the practical enforcement of "victim's standpoint" arguments should be adopted. This work examines how and in what contexts the institutional and patriarchal powers operate by focusing on the Quid Pro Quo harassment as the main issue of the sexual harassment on campus. The cases analyzed are the sexual harassments by professors occurred recently in three universities. Based on 14 in-depth interviews, including two group interviews, and related documents, the analysis focuses on the way the cases are deployed and experienced on campus. In the analysis of each stage of the deployment, this work tries to understand the ways those members involved construct the meaning of the sexual harassment by situating their experiences in the social contexts. In these cases, though the victims of the sexual harassments suffer incessantly through the everyday life on campus, thus proving that these are the cases of sex discrimination, the department-centered "we-ness" and the unequal power relations between professors and students help to generate various prevarications at each stage that make those involved hard to identify the sexual harassments as sex discriminations. This work shows that when the gender equality on campus has not been established, sexual harassments are not recognized as relevant to sex discriminations and, as a consequence, contribute to the maintenance and/or strengthening of the present gender hierarchy.
