19세기말-20세기초 대구 대암가 후손의 종손권 분쟁에 대한 고찰 -한국국학진흥원 소장 경주 최씨 칠계 백불암파 종중 기탁 고문서를 중심으로-

Abstract

Through micro-historical research methods, this study reconstructs the dispute over the right of eldest grandson and land dispute that occurred in the Baekbulam clan, Daegu from the late Joseon Dynasty to the Japanese colonial period, according to the development of events. and An analysis was attempted by selecting 90 related documents from among the Baekbulam clan materials deposited at the Korean Studies Institute. There are 27 Soji, 16 Tongmun, 3 Cheobjeong, 2 Gwanmun and Ipan, 1 Gamgyeol, Gisa, Wanmun, Pummok and 36 other documents. In the case of other documents, they are all modern records related to land litigation issued after the 1910s, including lawsuit files, reports of trial, documentary proofs, and judgments. The Baekbulam family was an influential family in the Daegu area in the late Joseon Dynasty. Since Choi Dong-jip entered Chilgye in 1616, Baekbulam Choi Heung-won and Jiheon Choi Hyosul completed their studies and became the mainstream of Yeongnam Toegye academic genealogy. Baekbulam Choi Heung-won's father, Choi Jeong-seok, inherited the head family's ancestral rites according to his father's will on behalf of his older brother who died without leaving a son. In addition, Baekbulam's younger brother, Choi Heung-jeom, was adopted as his deceased brother and held a ancestral rite. This incident became the start of a dispute over the right of eldest grandson that arose between relatives 200 years later. Starting with an incident in which the descendants of the adopted son who performed a ancestral rite for the eldest son who died young and the descendants of the second son who inherited the head family fought over the right of eldest grandson, we can see how this led to a dispute over the ownership of the land where the tomb of the ancestor they jointly worship was located.
