통신사업자 허가제도의 개선방향:휴대인터넷을 중심으로

현재의 통신허가제도는 사업허가 신청자들을 심사할 때 신청자의 재무 및 기술 측면의 능력만을 주로 고려하도록 설계되어 있으며 사업자 선정이 전체 통신시장에 미치는 영향은 고려 대상에서 제외되어 있다. 따라서 비록 심사기준 에 따라 신청자들 중에서 최고의 능력을 갖는 신청자를 사업자로 선정한다 하더라도 사회(국가) 전체적으로는 후생극 대화에 실패할 수 있다. 특히 본 논문은 2.3GHz 휴대인터넷 서비스를 포함한 무선통신사업의 경우 신규 사업자를 선정하느냐 혹은 기존의 사업자를 선정하느냐에 따라 경쟁 촉진과 혁신적이고 다양한 서비스의 도입이라는 통신정책의 핵심 목표가 영향을 받을 수 있음을 보이고 있으며 허가 신청자의 유형을 허가심사과정에서 고려할 수 있는 허가심사기준을 추가할 필요성을 제기하고 있다.
Abstract
Currently, an applicant is selected as a telecom licensee entirely based upon its financial and technical capability ignoring the effects of the applicant's characteristics on the social welfare. Therefore, licensing the most capable applicant does not guarantee maximization of social welfare. Specifically, this paper argues that competition and diversity of services in a wireless telecom market critically depends whether a license is given to an incumbent or a new comer. As a consequence, it is proposed that a licensing system include a criterion taking into account the incumbency of an applicant.
