2.3Ghz 휴대인터넷은 기존 유선 및 이동 통신서비스와 연관성이 커 허가시 지배력 전이 등 공정경쟁 이슈가 제기될 수 있다. 휴대인터넷 제공에 있어 필수설비를 보유한 사업자가 진입하는 경우 또는 이동전화와 휴대인터넷 모두를제공하는 사업자와 그렇지 못한 사업자가 나타나는 경우 휴대인터넷 시장 또는 기존 시장에서 공정경쟁 문제가 발생한다. 해외 관련 사례에서 나타난 다양한 구조적, 행태적 조건들을 국내에 적용함에 있어서는 휴대인터넷 개념이 아직불확정적임을 감안하여, 신규서비스의 성공적 도입·확산과 공정경쟁이라는 두개의 정책 목표간 적절한 균형이필요하다.
Abstract
Competition policy issues may arise in spectrum licensing for 2.3Ghz Portable Internet (PI) service which will be closely related to the existing services. In pariticular, when an essential facility holder enters or when some opertors end up with being a 2G-only provider or PI-only provider, a level playing field is hard to expect in either the existing market or the new market. In devising license conditions by internationally benchmarking similar cases, the government needs to have an utmost sense of proportion between the dual policy goals of launching a new service with success and ensuring a level playing field, given the unestablished concepts of PI service.
