현행법에 나타난 학교상담자의 비밀보장과 그 한계 고찰

초록

학교상담자들이 가장 많이 겪고 있는 윤리적 갈등 중 하나가 비밀보장과 관련된 것이다. 비밀 보장 뿐 아니라 그 한계 상황에서 보다 효율적인 대처를 할 수 있기 위해서는 관련된 법률은 어떤 것들이 있고 어떻게 규정하고 있는지에 대해 알 필요가 있다. 이에 이 연구에서는 내담학생의 사생활 보호를 위해 비밀을 엄수해야 한다는 법 규정에는 어떤 것들이 있는지에 대해 알아보고, 다음으로 비밀보장의 한계와 관련 있는 ‘학생의 권리와 학부모 권리 간의 갈등’, 명백한 위험으로부터의 타인을 보호해야 하는 ‘경고의 의무’, 아동학대․성범죄․전염성 질병에 대해 학교상담자에게 법으로 명시한 ‘신고 의무’, 학교폭력 상담 결과에 대한 ‘보고의무’, 그리고 ‘법정 증언’의 순서로 관련법을 고찰하고 논의하였다. 연구 결과 학교상담자는 ‘내담학생의 비밀 보장’의 책임에 대해서는 현행 법률로 명확하게 규정되어 있었다. 하지만 학부모의 상담 기록에 대한 권리와 경고의 의무에 대해서는 현행 법률로 규정한 바는 없었다. 그리고 신고의 의무는 윤리강령에서 규정하고 있지 않는 경우가 있으나 법률적인 책임이 있음을 밝혔다. 이 연구의 결과는 앞으로 윤리와 법률과의 관계에 대한 관심이 증대되는데 기여할 수 있을 뿐 아니라 학교상담자들의 비밀보장과 관련된 윤리적 갈등 해소에 도움을 줄 것이다.

Abstract

School counselors are facing ethical dilemmas related to confidentiality most commonly. It is necessary for school counselors to understand the relationship between ethical and legal codes about the confidentiality. So this study was to review legal codes related to school counselors' confidentiality and its limitation. By exploring legal codes regulating the confidentiality and its limitation, it was found that school counselors have legal responsibilities as well as ethical ones. Next, legal codes related to the limitation of the confidentiality was reviewed. The reviewed categories were 'responsibilities to parents/guardians', 'duty to warn', 'duty to report' which included child abuse, sex crimes, officially designated infectious diseases, and 'testimony in court'. The results showed that the responsibility to report the contents of the counseling to the parents/guardians and the duty to warn were not regulated in the current laws. But the duty to report was an legal responsibilities of the school counselors though it was not written in the ethical codes. This study will enlarge the interests in the relationship between ethical and legal codes and will help school counselors solve ethical dilemmas related to confidentiality.
