입법의 홍수 시대에 ‘보다 좋은 입법’ 을 위한 입법평가체계는 국민 삶의 수준을 개선시킬 수 있고, 법규범의 수용성과 실효성을 높일 수 있다는 측면에서 의미가 있다는 점은 주지의 사실이다. 본 연구는 최근 일부 지방자치단체에서 교육청 교육자치법규에 대한 입법평가 조례가 제정(대전, 부산, 인천, 전남)되고 있다는 점에 주목하고, 이와 같은 교육청 교육자치법규에 대한 입법평가 조례의 쟁점과 개선 과제를 검토하는 데 목적을 두고 있다. 현행 네 개 시･도 교육청 교육자치법규에 대한 입법평가 조례는 시행 초기이므로 향후 입법개선이 필요한 사항에 대하여 본 연구의 제3장과 제4장에서 검토하였다. 무엇보다, 지방교육자치법규도 ‘교육관계법령 등’에 해당되므로 교육법의 특수성이 고려된 규범적 적정성에 대한 검토가 요청되며, 지방교육자치법규 입법목적에 대한 사실적 실효성 및 효과성 분석을 위한 입법평가 체계가 요청된다. 향후 과제로는 지방교육자치법규 성격에 적합한 규범적 적정성 검토 기준 마련, 실효성 및 효과성 분석을 위한 체계적인 데이터의 수집과 관리 체계 구축, (가칭)지방교육자치법규에 대한 입법지원센터 구축 및 지원 등 세 가지 사항을 제안하였다.
Abstract
Purpose: This study aims to examine the issues and challenges surrounding legislative evaluation ordinances, with a particular focus on the recent enactment by local governments regarding the evaluation of education-related legislation. Design/methodology/data/approach: The study adopts a legislative policy perspective. It conducts a literature review of legal texts, legislative policy documents, academic journals, and other materials related to relevant laws, which is commonly used in legislative policy research. Findings/Results: Legislative evaluation ordinances for education can be seen as regulations that reflect the specific characteristics of the education sector. These ordinances require a review of their normative appropriateness, as well as an analysis of their effectiveness and impact. Value: This study provides valuable insights for the enactment and revision of legislative evaluation ordinances for educational regulations in Korea from a legislative policy perspective.
