전자감독 대상자 재범 가능성에 대한 담당관 면담과 원호지원의 조절효과 연구

Examining the Moderating Effects of Officer Interviews and Supportive Assistance on the Likelihood of Recidivism Among Electronic Supervision Offenders

초록

법무부 발표 자료에 따르면 전자감독 현재원은 지속해서 증가하고, 전자장치 부착 대상 범위도 확대되고 있지만, 정부 예산안을 살펴보면 단기간 전자감독 전담직원의 충원은 한계가 있다. 이에 따라 법무부 범죄예방정책국에서는 전자감독 대상자를 효율적이고 효과적으로 관리하기 위해 재범 예측지표 개발에 노력하고 있다. 이 연구는 이러한 배경을 바탕으로 전통적인 범죄예측 지표인 전과가 전자감독 부착기간 중 준수사항을 위반하여 경고장을 받은 것과 상관관계가 있는지, 그리고 전자감독 대상자의 재범 가능성을 조절하는 요인이 무엇인지에 관해 검증하는 것을 목적으로 한다. 구체적으로 선행연구 검토에 따라 전자감독 대상자가 준수사항을 위반하여 경고장을 발부받은 횟수가 많을수록 재범 가능성이 큰 것으로 설정하였고, 전과와 경고장 발부 횟수와의 관계를 확인한 후 담당관 면담과 원호지원이 이 관계를 조절하는지에 대해 검증하였다. 연구 결과, 전과는 경고장 발부 횟수와 유의한 정(+)적인 관계가 있었다. 다음으로 담당관 면담은 전과와 경고장 발부 횟수의 관계를 증가시키는 것으로 조절하는 효과를 보였다. 또한, 전과와 경고장 발부 횟수의 관계에서 담당관 면담의 조절효과에 대한 원호지원의 조절효과도 정(+)적으로 유의하게 나타났다. 즉, 원호지원이 많을수록 경고장 발부 횟수가 증가하는 것이다. 이러한 결과를 바탕으로, 전자감독 대상자에게 강압적이고 과도한 밀착감독을 지양하고, 조건 없는 금전적 지원이 아닌 재사회화에 초점을 맞춘 실효성 있는 원호지원 프로그램을 운영해야 한다는 정책적 제언을 제시한다.

Abstract

According to data released by the Ministry of Justice, the current number of electronic supervision is constantly increasing and the scope of electronic devices is expanding, but the government's budget proposal limits the number of dedicated electronic supervision staff in the short term. Therefore, the Ministry of Justice's Crime Prevention Policy Bureau is working to develop recidivism predictors to efficiently and effectively manage those under electronic supervision. Based on this background, this study aims to verify whether criminal convictions, a traditional predictor of recidivism, are correlated with the receipt of warning letters for non-compliance during the period of electronic supervision, and what factors regulate the likelihood of recidivism among electronic supervision recipients. Specifically, based on a review of the literature, we hypothesized that the more warning letters a supervised person received for noncompliance, the greater the likelihood of recidivism, and we examined the relationship between criminal convictions and the number of warning letters, and then tested whether officer interviews and supportive services moderated this relationship. We found that criminal convictions had a significant positive relationship with the number of citations. The moderating effect of officer interviews was to increase the relationship between criminal history and the number of citations issued. The moderating effect of support on the moderating effect of officer interviews on the relationship between criminal history and the number of citations issued was also positive and significant, i.e., more support was associated with more citations. Based on these findings, the policy recommendation is to avoid coercive and excessive close supervision of electronic supervision recipients and to operate effective support programs that focus on resocialization rather than unconditional monetary support.
