외국의 사례를 통한 국내 아동 성범죄자 약물치료의 실효적 운영 방향

우리나라는 아동을 성폭력 범죄로부터 보호하기 위한 다양한 정책들을 실시하여 왔으며, 2011년 7월에 아동 성범죄자에 대한 의료적 약물치료 명령 즉, 화학적 거세 법안이 통과됐다. 이러한 의료적 약물치료 즉, 화학적 거세는 미국 캘리포니아 주와 유럽의 독일, 덴마크, 폴란드, 핀란드, 체코, 러시아 등에서 시행하고 있지만 아시아에서는 한국이 처음으로 도입하였다. 그런데 폴란드를 제외한 현재 유럽 대부분 나라들은 당사자의 동의와 심사위원회의 승인을 거쳐 약물 투여를 결정하도록 제한하고 있다. 또한 미국에서도 성폭력범죄자 처우의 방안으로 형확정을 받은 범법자가 자유의지로 자신의 형기를 감형 시키는 한 수단으로써 이러한 약물의 사용이 허용되고 있다. 이런 외국의 사례와는 우리나라의 경우 큰 차이가 있다고 할 수 있다. 이에 본 연구는 아동 성범죄자의 약물치료에 대한 외국 사례를 바탕으로 우리나라의 아동 성범죄자에 대한 의료적 약물치료 즉, 화학적 거세의 문제점을 파악하여 실효적 운영방안을 모색함으로써 아동 성범죄 예방과 재범방지에 필요한 기초자료를 제공하고자 하였다. 우리나라의 화학적 거세 시행은 기본권을 침해할 우려와 약물을 투여하였을 경우 나타날 수 있는 부작용을 최소화하는 작업, 2중 처벌의 논란 등의 많은 문제점이 제기되고 있다. 따라서 아동 성범죄자에 대한 약물치료가 보다 실효적으로 시행되기 위해서는 처벌이 아닌 치료의 목적과 기능이 강조되어야 하며, 대상자의 동의 요구 및 통합적인 성범죄자 치료·교육프로그램의 개발·적용이 필요하다. 또한 성충동 약물치료가 보다 실효성 있게 운영되기 위해서는 성도착증 환자의 평가과정과 진단기준, 평가주체가 중요하며, 자문단에 대한 사전교육과 철저한 관리가 요구된다.
Abstract
The study In South Korea, various policies have been implemented to protect children from sexual violence crimes. In July, 2011, the medical drug treatment order or chemical castration bill passed for sex offenders against children. The medical drug treatment or chemical castration approach has been in practice in California, the U.S.A. and many European countries including Germany, Denmark, Poland, Finland, the Czech Republic, and Russia. South Korea was the first nation in Asia to introduce the approach. Most of the European countries except for Poland, however, put limits on its practice by allowing for drug administration only after consent from the offender and approval from the review committee. In the U.S.A., such drugs are allowed as a means for the convicted offender to reduce his sentence and a method of treating sex offenders. These foreign countries cases are widely different from the case of South Korea. This study thus set out to identify problems with the medical drug treatment or chemical castration method for sex offenders against children based on overseas cases, search for effective management plans, and provide basic data needed to prevent sex crimes against children and their recurrence. In South Korea, chemical castration has faced many problems including the potential violation of the basic right, the minimization of side effects after drug administration, and the controversy over dual punishment. It is thus needed to emphasize the goals and functions of treatment rather than punishment, get consent from the offender, and develop and apply an integrated treatment and education program for sex offenders so that drug treatment for sex offenders against children will be implemented more effectively. It is important to determine the evaluation process, diagnosis criteria and evaluation subject of sexual perversion patients and provide the advisory panel with prior education and thorough management to ensure the more effective management of drug treatment for sexual impulse.
