성충동 약물치료와 관련하여 성충동약물치료에 대한 위헌성여부만큼이나 논란이 많은 것은 이 제도가 형사정책적으로 성폭력범죄를 예방하는데 과연 효과성이 있는지의 문제이다. 신상공개제도나 전자감시제도가 성폭력범죄의 재범을 방지하는데 일정한 효과를 나타내고 있는 것에 비하여 성충동약물치료는 도입한지 오래되지 않았고 치료명령의 선고나 집행 건수 자체가 적다보니 통계적 수치를 산출하거나 실증적 효과성를 증명하기는 어렵다는 것이 기존의 연구결과 였다. 그러나 최근 들어 한국에서도 성충동 약물치료에 대한 통계자료가 축적되고 집행현황의 수치가 증가하면서 효과성을 분석할 수 있는 기반이 마련되었다고 할 수 있다. 이에 본 연구에서는 최근의 국내에서 발표된 통계와 실증적 연구결과를 분석하여 성충동 약물치료가 성폭력 가해자의 성적 환상 및 태도 감소에 효과적이고 성폭력 재범율을 감소시킬 수 있는 치료적 대안이 될 수 있음을 주장하였다. 또한, 이러한 몇 가지 개선방안을 제시함으로써 보안처분인 성충동 약물치료의 정당성을 주장하였다.
Abstract
As controversial as to the unconstitutionality of sex offenders drug treatment system, the question is whether this system is effective in preventing sexual violence crimes in criminal policy. Compared to the fact that the new disclosure system personal information and position monitoring electronic surveillance system have a certain effect on the prevention of sexual violence crimes, sex offenders drug treatment system have not been introduced for a long time, and the number of sentencing and execution of treatment orders is small. It was a traditional argument that it was difficult to prove. In recent years, however, statistics on sex offenders drug treatment system have been accumulating in Korea, and the number of execution status has increased. Therefore, this study analyzes the recent statistics and empirical results published in Korea, suggesting that sex offenders drug treatment system can be effective in reducing sexual fantasies and attitudes of sexual violence abusers and can be a therapeutic alternative that can reduce the rate of sexual violence. It was. Also, by suggesting some of these improvements, we justified the security-measure of sex offenders drug treatment system.
