성충동 약물치료 효과의 문제점과 법적 요건

초록

2010년에 제정되어 2011년부터 시행되고 있는 “성충동 약물치료법” (Chemical Castration)은 성범죄자의 성욕을 억제시켜서 재범을 방지하고자 도입된 보안처분의 일종이다. 그러나 현재의 성충동 약물치료법은 성범죄자의 동의 없이 검사의 청구와 법원의 판결로 시행될 수 있다는 강제성 때문에 자기결정권의 기본권을 침해한다는 문제가 있다. 그 외에도 성충동 약물치료 판단 시점의 문제, 사용되는 약물로 인한 부작용 가능성 등이 문제점으로 제시되고 있다. 하지만 현재까지 이 치료가 성범죄자의 재범방지에 정말로 효과적인지에대한 논의는 거의 없었다. 따라서 이 연구에서는 성충동 약물치료의 규범적인정당성 외에도 의학적으로도 과연 성충동 약물치료가 성범죄자의 재범방지에효과적인지에 대한 근거를 확인하기 위하여 현재까지 발표된 국내 및 외국의임상연구들을 검토하였다. 이와 더불어 법령과 시행령의 문제점도 살펴보았다. 결론적으로 성충동 약물치료가 성범죄자의 재범방지에 효과적인지 과학적 근거가 상당히 미약하여 명확히 결론 내기 어려운 반면에 약물치료와 관련된 부작용은 약물치료 대상자들에서 상당수 발생함을 확인할 수 있었다. 이런 논증 과정을 통해서 성충동 약물치료가 법상 요건을 결하였음을 확인하였다.

Abstract

The drug treatment for sexual impulse was legislated on July 23, 2010, and the law has taken effect since July 24, 2011. 'The drug treatment for sexual impulse' stipulated in this law is called as 'Chemical Castration', which was introduced for prevention of the secondary crime of sexual violence crime through the hormone treatment to suppress the sexual desire of the sexual criminals. However, the drug treatment for sexual impulse has some constitutional problems in its nature as well as debates over the likeliness of the prevention of the offenders from committing crimes again. We evaluated the effects of pharmacological interventions on target sexual behavior for people who have been convicted or are at risk of sexual offending using a variety of already published clinical studies. In conclusion, scientific evidences for the drug treatment for sexual impulse were quite too small to decide whether or not this treatment is really efficacious to prevent of recidivism. However, relatively various side effects were reported. Moreover, many guidelines requires informed consents before carrying out the treatment. Thus, current drug treatment for sexual impulse is not scientifically proven to prevent secondary crime of sexual violence criminals and we raise the concerns about maintaining current treatment law.
