그루밍 성범죄 처벌 규정 입법 개선방안에 관한 연구:영국 법제와의 비교 중심으로

2019년 ‘텔레그램 N번방 사건’을 계기로 대한민국 정부는 아동·청소년 대상 성범죄를 근절하고자 2021년 3월 21일 청소년성보호법을 개정하였고, 이러한 개정을 통하여 ① 온라인 그루밍 성범죄 처벌 규정(제15조의2) 및 ② 신분위장수사·신분비공개수사(제25조의2 등)와 같은 수사 특례규정을 우리 법제 최초로 도입하기에 이른다. 하지만 이러한 개정 노력에도 불구하고, 개정 청소년성보호법의 한계점 또는 개선점으로 (선행연구 분석 결과) 크게, ① 구성요건이 ‘정보통신망’으로만 한정되어 있어서, ‘오프라인’상에서 발생하는 성착취 목적의 대화는 처벌이 어렵다는 점, ② 그루밍 성범죄 처벌 규정에 ‘미수범 처벌 규정’이 없으므로, 이러한 범죄에 대하여 신분위장수사 및 신분비공개수사 자체가 허용되지 않는다는 점, ③ 구성요건상 지속성 또는 반복성이 요구되므로, ‘일회성 그루밍’ 자체는 처벌할 수 없다는 점 등이 확인되었다. 본연구는 이러한 한계점에 대한 입법적 개선방안을 제시하고자, 그루밍 성범죄 처벌 규정을 세계 최초로 입법화하고 이와 더불어 아동·청소년 대상 성범죄 등에 대한 종합적인 평가를 거쳐 이를 실정법으로 모두 반영한 ‘2003년 영국 성범죄처벌법’ 및 이와 관련된 판례를 비교법적으로 고찰해보고자 하였다. 본 연구는 이러한 비교법적 고찰을 토대로 시사점을 도출하고, 이러한 시사점을 토대로 궁극적으로 우리의 청소년성보호법의 입법 개선 담론에 관한 방향성을 제시하고자 하였다.
Abstract
The South Korean government amended the ‘Act On The Protection Of ChildrenAnd Youth Against Sex Offenses’ in May 2021 in response to the ‘Telegram Nth Room’ case, a series of online child sexual abuse cases that shocked the nation. The amendment criminalized online sexual grooming and introduced special investigative measures, such as undercover investigations and concealed identity investigation. Despite these legislative efforts, analysis of literature reviews has found that the amended Act still has some limitations. Firstly, the offense is limited to communications on information and communication networks, making it difficult to prosecute conversations for the purpose of sexual exploitation that occur offline. Secondly, the offense does not have a provision for attempted offenses, making itimpossible to conduct undercover investigations and investigations without disclosing the identity of investigators for these offenses. Thirdly, the offense requires continuity or repetition, making it impossible to prosecute one-time sexual grooming. Finally, the act needs to be amended to require the offender to bear the burden of proof regarding his or her awareness of the victim's age (under 19 years of age). This study proposes legislative alternatives to address these limitations. Noticeably, it compares the UK’s ‘Sexual Offences Act 2003’ which was the first in the world to criminalize sexual grooming, and related case law. Based on this comparative study, the research draws implications and ultimately proposes specific directions (alternatives) for the legislative improvement discourse of the Act On The Protection Of Children And Youth Against Sex Offenses in South Korea.
