아동성착취, 섹스팅, 온라인 그루밍:개념 규정과 처벌법규에 대한 논의

n번방 사건 등 디지털 성범죄가 사회적 이슈가 되며 ‘온라인 그루밍 처벌법’이 신설되었으나 아직 한계가 있다. 그 한계를 짚어보기 위하여 본 연구는 먼저 온라인 그루밍의 발생 환경에 대해 알아보고자 아동성착취, 섹스팅의 개념을 짚어보고 이것이 문제시 되는 상황에 대하여 논하였다. 다음으로 온라인 그루밍의 개념에 대해 알아보고 그 특성을 파악하고자 하였다. 아동성착취는 아동에게 물질적, 정신적인 대가를 제공하거나 약속한 상태에서 아동을 성적으로 이용하는 것을 말한다. 섹스팅은 학대적인 성격을 가지는 경우와 실험적인 성격을 가지는 경우로 나뉠 수 있는데, 성인이 참여한 경우라면 학대적 성격으로 분류된다. 이 때 성인은 아동을 자신의 요구대로 행동하도록 하기 위해 심리적 조작을 하게 된다. 온라인 그루밍은 성인이 미성년자를 성착취를 용이하게 하기 위해 온라인상에서 이들을 심리적으로 조작하는 행위로 그 단계에 따라, 내용에 따라 분류할 수 있다. 또한 온라인 그루밍의 가해자 특성과 피해자 특성을 살펴보았다. 본 연구는 성착취, 섹스팅과 온라인 그루밍의 개념과 특성에 대해 종합적으로 논의하고 그 내용을 토대로 현재 법률상의 한계점을 짚어보았다는 점에서 의의가 있다.
Abstract
Cases such as “The nth room” had become a major social issue in South Korea. Consequently ‘online grooming prevention legislation’ was adopted last year, but it still has some limitations. In order to discuss about those limitations, it was aimed to first conceptualize child sexual exploitation, sexting, and online grooming of children. The concept of child sexual exploitation differs from the concept of child sexual abuse as, in its definition, a victim of child sexual exploitation is requested sexual activities in exchange for any kinds of benefit. Sexting can be categorized as aggravated or experimental, and it is considered aggravated when adult participates. Online grooming is a manipulative tactic the adult uses in order to make his sexual exploitation of the child easier and harder to detect. Stages and characteristics of online grooming was also discussed. Finally, it was discussed the need to reconstruct the current legislation for better protecting child from online grooming and sexual exploitation.
