Abstract
This study highlights the entrenched reliance on a recording-centered structure in contemporary suspect interrogations and advocates for a transition to a dialogue-centered model. The existing framework, in which investigators summarize and edit suspects’ statements to produce written records, has long been associated with issues such as distortion and bias. To address these concerns, this study examines investigative interviewing frameworks adopted in common law jurisdictions, including the ACFE’s structured interview method in the United States, the PEACE model in the United Kingdom, and the FBI’s custodial recording policy. It further explores the implementation of AI-based automatic speech recognition (ASR) technologies by the Norwegian police and in South Korean medical settings, illustrating their potential to facilitate a transition to dialogue-based interrogations. A dialogue-centered approach enables investigators to focus on building rapport and engaging in meaningful interaction, rather than being burdened by manual transcription. This reduces the likelihood of statement distortion while enhancing procedural transparency and safeguarding human rights. Ultimately, it contributes to safeguarding suspects’ rights of defense, humanizing the investigative process, restoring legitimacy and public trust in law enforcement, and reinforcing the principles of adversarial criminal justice.
