본 연구는 강원특별자치도 내 중고등학교 학칙의 학생회 관련 조항을 비교･분석하여 학생회 활동의 실태와 문제점을 파악하고, 학생회 활동의 내실화를 위한 학칙 개선 방안을 모색하는 것을 목적으로 한다. 분석 결과, 많은 학교에서 학칙이 학생회를 대의원회와 집행위원회 중심으로 규정하여 소수 임원을 제외한 일반 학생의 참여가 제한되고, 학생회 조직･운영 및 임원 자격에 대한 학생의 자율권이 제약되고 있었다. 또한 학생회의 학교 운영 참여 권한이 부족하고, 일부 학교에서는 학생회 활동을 제한하거나 상위법에 저촉될 소지가 있는 조항도 규정하고 있었다. 이에 본 연구는 학생회 활동의 학생 참여의 확대, 학생회 조직 및 운영의 자율성 강화, 학교 운영에 대한 실질적 참여 권한 보장, 상위법 저촉 및 학생회 활동 제한 규정의 점검 및 개선 등의 학칙 개선 방안을 제언한다.
Abstract
This study compares student council–related provisions in the school regulations of middle and high schools in Gangwon Special Self-Governing Province to identify the current status and issues of student council activities and to propose regulatory reforms for their enhancement. The analysis shows that many regulations define the student council primarily through a representative council and an executive committee, thereby limiting participation by non‑officer students, while constraining students’ autonomy over the council’s organization, operation, and officer eligibility. In addition, students’ rights to participate in school governance remain insufficient, and some schools maintain provisions that restrict council activities or may contravene higher‑level statutes. Accordingly, this study recommends reforming school regulations to expand student participation in council activities, strengthen autonomy in council organization and operation, guarantee meaningful participation rights in school governance, and review and revise provisions that restrict council activities or conflict with higher‑level laws.
