Abstract

This paper attempts to give an overview of the Roman empire’s practices of administering public documents both at the center (imperial government) and in the provinces (governors and municipal cities) during the first three centuries C. E. Two aspects are specially highlighted: archiving in tablet depositories (tabularia) and posting (propositio) of bronze or limestone inscriptions. These were the principal means of how public documents were accessible to the general public, particularly those of inferior status like provincials who wanted their interests and rights to be reconfirmed by the imperial government (emperor or governor). The author also intends to reveal that the uniquely Roman habit of disposing public documents, as is exposited in this paper, was an indispensible device to compensate for the underdevelopment of bureaucracy necessary in administering the huge and vast empire. Emperors tended to address the provincials (or their municipal elites) in un-mediated ways for their loyalty and financial contribution, while responding diligently in return to latter’s various petitions and inquiries, thus creating inadvertently a sort of ‘governance’, in which communication through documents and/or delegates was made most of, perhaps to an unprecedented extent in pre-modern times. In addition, the author wishes to draw attention to the legacy of the Roman documentation practices in the development of Roman laws and jurisprudence. As emperors had inevitably begun to be assisted in responses to all sorts of subjects’ complaints by the advisory of the most renowned legal experts of the time, the cardinal types of documents issued from the imperial office such as edicta, decreta, mandata, rescripta were all ultimately treated as the sources of law.
