국민기초생활보장제도에서 제도적 개인화의 쟁점

이 연구는 “제도적 개인화”의 측면에서 국민기초생활보장제도(이하 ‘기초보장’)의 법률, 규정, 급여체계를 분석하였다. 분석결과 첫째, 부양의무자 기준이 대폭 축소되었지만 가구간(inter- household) 부양의무자 기준이 완화되었을 뿐 가구내(intra-household) 부양의무자 기준은 광범위하게 유지되고 있다. 함께 사는 형제자매는 “특히 필요하다고 인정하는 경우”가 아니면 부양의무자로 간주되며, 30세 미만의 미혼 청년은 따로 살더라도 부모와 독립된 가구로 보장받기 어렵다. 또 청년층을 대상으로 “자립지원 별도가구” 규정이 도입되었지만 20대 청년층에 대한 제도적 개인화 수준은 낮다. 둘째, 기초보장이 수급가구간 욕구를 차등화하는데 사용하는 가구균등화지수를 검토했을 때 우리나라 가구균등화 지수는 가구규모에 따라 급여를 차등화하며 가구특성, 가구의 질적차이를 고려하지 못하는 문제점이 있다. 가구원들의 욕구를 생애주기별, 가족관계적 특성(독신/커플/자녀수)으로 구분하는 등 현실적으로 공동생활을 영위하고 있는 가족구성원들의 지출을 반영한 세분화된 급여제도도 검토할 필요가 있다. 이 연구는 기초보장 규정들에 내재된 가족주의 유제를 분석하고 기초보장에서 개인화된 사회권 확대의 필요성과 관련하여 논의하였다.
Abstract
This article analyzes regulations and benefit system of the National Basic Livelihood Security Program (hereafter referred to as ‘BLSP’), focusing on the process of “institutional individualization”. By examining the laws, regulations, and guidelines of the BLSP, we explores how the mechanism of individualization operates while upholding institutional familialism principles. First, although the criteria for family obligation has been significantly reduced, the principle of family support priority has not been abandoned. While the inter-household family obligation criteria have been relaxed, the intra-household obligation is largely maintained. Siblings living together are considered obligated family supporters except the “particularly necessary” cases. Unmarried individuals under 30 find it challenging to receive state support as independent householders even if they live apart from their parents. Although “the separation of household rule” to support independent living for young people has been introduced, the level of institutional individualization for individuals in their 20s is still quite low. Second, we examine the household equivalence scale chosen by the BLSP to secure the differentiated needs among the benefit households. The current scale mainly considers the size of the household and does not take account for the characteristics and qualitative differences of recipient households. Given that European countries adopt various methods to consider the qualitative diversities of the benefit households, there is a need for developing alternative measures to make the benefit level of the BLSP adequate and appropriate for diverse needsof the low income families.
