Abstract
Cicero’s letter to his friend Atticus on the 15th March 60 B.C. has some decisive information about the Roman senate, describing the pedarii, who revealed the structural aspect of it. He lamented that not senators with authority but the will of the pedarii had decided the senate’s ruling about the free provincials, who had been oppressed by a debt problem. This decision seemed to cause Atticus to lose a big chance of attaining money. Cicero also had compassion on him, regretting the impossibility of canceling the decision. This historic and revolutionary moment in the senate was brought about through the majority of the senate members, that is the pedarii, on whom we should pay attention. But it has been not easy to identify the pedarii because of both of the inconsistent materials and of the various perspectives. Considering the difficulties, I tried to focus on materials and opinions suitable to attempt an understanding of Cicero’s letter, based on Willems’ and Mommsen’s writings together. The former argued that the pedarii meant the senators not beyond ex-quaestorship, and the latter that the senate had been composed both of the senators and the equestrian for a long time. The senate had been composed of the two orders after the supplements. This fact is certain during the dictatorship of Sulla, who stopped the process of electing the censors. After that the situation does not change, considering the practice of selecting members from the class directly below the senators, and the possible holding of equestrian status by the ex-magistrates before the censors’ admittance. Additionally the young noble men also had the equestrian status, sitting in the senate. So the term pedarii covered the majority of the senate members and these were separated from the higher senators, that is, the ex-consuls and ex-praetors. The Tabula Hebana revealed a kind of senate meeting from this perspective. Sulla allotted one vote for each tribe, enlarging the senate with 300 members added. And according to Tacitus, the right of magistrate election was transferred from the centuriate assembly to the senate. It was possible for the pedarii to force senate decisions through their own will, which was made possible by accepting the equity of the free provincials. This knowledge of senate structure helps us to understand the situation of Cicero, embarrassed by the actions of the pedarii.
