한․일간 성년후견제도의 비교

현행 우리민법상에 있어서도 성년후견제도로서 금치산과 한정치산제도를 가지고 있다. 그러나 현행의 금치산과 한정치산제도는 그 이용적인 측면에서 살펴보면, 이용하기 쉽지 않을 뿐만 아니라 실제로도 거의 이용되지 못하고 있는 실정이다. 더욱이 현행제도가 고령자의 판단능력이 불충분하게 되는 경우 이를 보호하기에는 부족한 점이 있다. 따라서 현행의 제도를 시대에 부응하는 새로운 제도로 개정하는 것이 바람직할 것이라 본다. 이와 같은 입장에서 생각해보면, 새로운 제도로 개정하게 되는 성년후견제도는 본인 보호의 이념과 본인의 자기결정의 존중을 조화시키는 관점에서 출발하여 치매고령자, 지적장애자, 정신장애자 등의 사회적 상황을 충분히 고려하여 유연하고 탄력적인 제도가 시행되는 것이 중요하다고 본다. 끝으로 새로운 성년후견제도의 정착을 위한 제언으로 세 가지를 제시하고 대안을 적시하였다. 첫째, 공적지원제도 및 법률기반 구축을 위해서 무자력자에 대한 공적지원제도를 통해 성년후견이 有産者만을 위한 제도가 아니라 후견을 필요로 하는 자라면 누구나 이용할 수 있는 제도가 되어야 할 것이다. 또한 재정적 지원협력을 유도하는 법률제정과 아울러 유관기관과의 네트워크 구축의 강화를 강조 하였다. 둘째, 성년후견인의 양성과 성년후견서비스 수준의 학보를 위해서 성년후견인 양성 및 보수교육을 담당할 수 있는 기구를 마련하는 것과 함께 재산관리와 신산보호를 위해 전문성을 가진 기관을 체계적으로 조직화할 필요가 있다. 셋째, 법원의 인적 ･물적 인프라 확충은 성년후견에 관한 업무를 제대로 수행할 수 있는 전담법관, 가사조사관 등의 증원과 함께 전문성을 확대하는 지름길이다.
Abstract
As Adult Guardianship Laws, Korea has stipulated regulations for incompetent and quasi-incompetent individuals in its civil laws. However, the current regulations for incompetent and quasi-incompetent persons are not easy to be applied when they are reviewed for their application, and they are rarely applied in practice. Moreover, the current law system for the matter hereof has the defect that it cannot fully protect interests of the aged who have lost their judgement. Thus, the current law system seems to be amended to keep up with the times. From this point of view, I consider that Adult Guardianship Laws to be newly amended should be executed in flexible way by fully taking into consideration the social factors and situation including the elderly with dementia and intellectually or mentally challenged people while having its basis on harmony between the concept of self protection and respect to self-decision of individuals. Finally, I made three suggestions and stated solutions for settlement of the new Adult Guardianship Laws. Firstly, the new system is required to be a such system that can be applied for anyone who needs the help of guardianship not only for those with property through establishment of proper public and social support systems and legal grounds for those who lack means. Also, I focused on the importance of establishment of laws and regulations that lead to proper financial support and cooperation and of network with relevant organization. Secondly, I consider that training institutions to cultivate adult guardians and to confer follow-up training should be established for training of adult guardians and high standards of adult guardianship service and that professional organizations should for systematically formed for protection of property and personal welfare. Thirdly, I think that expansion in personnel and financial infrastructure of the court along with increase in employment of judiciary officials and family fact-finding officers who can perform adult guardianship service properly could lead to enhancement of professionalism in execution of adult guardianship system
