여기서는 향후 동아시아권의 대테러리즘을 위한 합리적 입법 방향은 무엇인지를 살펴보았다. 이를 위해 우선 대한민국의 대테러리즘 입법 활동의 현황을 요약하면서 무엇이 지금까지 대테러리즘 입법추진의 장애물이었는지 확인해 보고, 나아가 앞으로의 입법과정에서도 쟁점이 될 수 있는 내용은 무엇인지를 정리해보았다(Ⅱ). 이어서 비교법적인 인식획득을 위해 UN과 EU의 대테러리즘의 입법정책 및 실행방향에 대한 핵심내용을 정리하면서, 한, 중, 일 등 아시아 중심 국가들의 대테러리즘 입법에 대한 시사점은 무엇인지 찾아보았다(Ⅲ). 끝으로 이 글에서 살펴본 내용을 기초로 하여 앞으로 동아시아 중심 국가들의 대테러입법의 추진방향은 어떤 모습이어야 할지에 대한 개인적인 생각을 정리했다(Ⅳ).
Abstract
This paper proposes the future direction of rational legislation for the counterterrorism in East Asia. First, this article introduces the status of anti-terrorism legislation in the Republic of Korea. The author deals with the current issues about the barriers of anti-terrorism legislation in Korea, and describes the problems which could be occurred in the future in the legislative process on terrorism. To obtain some comparative legal knowledge, the author then summarizes the status of the EU and UN’s anti-terrorism legislation and introduces the mutual cooperation strategies in EU and UN. In conclusion, this paper’s proposal is as follows: individual countries should be prepared for immediate domestic terrorism legislation. Korea, China and Japan have to strengthen criminal judicial cooperation in counter-terrorism activities. They should provide a legal basis to enable a hierarchical organization for the rapid and effective actions against terrorism. We should not neglect to keep an eye on whether the anti-terrorism legislation infringes an individual’s fundamental rights and the treat of terrorism destroys the diversity of human life and belief. And the author guesses, the actual trends of terrorist’s actions that occur in the Earth’ everywhere, provide for Asian nations, ironically, a great opportunity to implement their own mutual-judicial assistance and to found a similar institution like Eurojust and Europol.
