형사사법시스템 개혁의 주안점이 가해자(처벌 또는 인권보장)에서 피해자(보호 및 지원)으로 이동고 있는 가운데, 피해자 보호의 패러다임에도 근본적인 변화가 요구된다. 기존 국가의 시혜적 차원에서 기획된 공급자 위주의 피해자 시책은 다양한 유형의 피해에 무력할 수 밖에 없다. 피해자의 요구가 잘 반영되지 않을 뿐 아니라 접근도 어렵고 공급자의 결정을 하염없이 기다려야 한다. 하지만 피해자의 입장에서 가장 유리한 방향으로 설계된 제도 하에서 피해자는 권리의 주체로서 필요한 조치를 적극적으로 요구하며 국가는 이에 즉시 반응할 의무가 있다. UN과 선진 각국이 취하고 있는 피해자 보호‧지원 정책을 살펴보면 ①신속한 접근 ②수요자 중심 ③지역우선 ④다자간 협력의 네 가지 대원칙을 도출해 낼 수 있다. 이에 비추어 보면 우리의 피해자 관련 법제도는 특별법 위주-중앙정부(법무부) 주도의 지원체계-민간단체의 수준저하-지방자치단체와 경찰의 역할부족과 같은 문제점을 안고 있다. 따라서 관련 법제도는 다음과 같이 개선될 필요가 있다. 현장 경찰관이 신속‧적절한 신변안전 및 임시조치를 취할 수 있도록 과감한 권한이양이 필요하다. 발생 직후 경찰에 의한 범죄피해 영향평가-상담-권리고지가 이루어지게 하고 수사 및 재판절차에 피해자의 참여권을 확대해야 한다. 구조금 지급을 비롯한 피해자 보호‧지원과 민간단체 관리에 있어 지방자치단체가 주된 역할을 수행해야 한다. 피해자 정책이 일관성을 가질 수 있도록 범죄피해자보호위원회의 위상을 재정립하고 경찰-지방자치단체-민간 지원단체 간의 견고한 협력체제를 유지해야 한다. 범죄피해자 정책은 수요자인 피해자가 가장 원하는 내용의 서비스가 가장 신속하게 가장 가까운 거리에 있는 기관으로부터 제공될 수 있어야 하기 때문이다.
Abstract
The center of the reform of the criminal justice system is moving from the perpetrator to the victim. A fundamental change is also needed in the paradigm of victim protection. State-centered victims' policies have no effect on various forms of harm. The victim's requirements are not reflected. Access to the service is also difficult and should wait for the supplier's decision. However, under the system designed from the perspective of the victim, the victim is the subject of the rights, so he can actively demand the necessary measures and the state must respond immediately. Four major principles can be found in the victims policy of the United Nations and other advanced countries. It is ①a rapid approach, ②consumer-centered, ③regional-priority, ④multilateral cooperation. However, the victim system in Korea has a problem of special law-oriented, central government-led, low quality of civilian organizations, lack of role of local governments and police. Therefore, relevant laws and institutions should be improved as follows. The police officers in the field should be empowered to act promptly and appropriately to protect the person and to take temporary measures. Evaluation of the impact of crime by police, assessment of damage, and notification of the victim's rights should be made. Victims should be able to actively participate in investigations and trial proceedings. Local governments should play a major role in paying for damage, protecting and supporting victims, and managing civilian organizations. In order to ensure that victim policies are consistent, the Committee for the Protection of Crime Victims should be elevated. The cooperation system between the police, local governments and civilian support organizations should be maintained. The crime victim policy should be designed so that victims receive the services they need most quickly and from the nearest distance.
