영국 피해자 보호․지원 정책의최근 동향과 그 시사점

올해는 ‘범죄피해자 보호·지원에 관한 제2차 기본계획’이 종료되는 해이자 제3차 기본계획을 수립하여야 하는 중요한 해이기도 하다. 제3차 기본계획 수립 시에는 지난 제1·2차 기본계획 수립시의 시행착오를 되풀이하지 않는 것이 중요할 것인데, 영국의 사례는 우리의 정책 수립에 많은 시사점을 제공해 줄 수 있다. 우리와 비슷한 문제를 겪고 있던 영국은 최근 피해자 보호·지원체제를 대폭 수정하였을 뿐만 아니라, 피해자규칙을 개정하여 피해자 중심의 형사사법시스템으로의 전환을 추진하였기 때문이다. 효과적인 피해자 보호 및 지원을 위해서는 다양한 과제 발굴이 중요하다는 점에서 영국의 제도개선은 우리의 정책 수립에 중요한 참고자료가 될 수 있을 것이다. 영국의 제도개혁은 피해자 지원체제의 지방이관을 통한 지역중심의 맞춤형 보호·지원서비스 제공, 피해자 중심의 형사사법 운영, 가해자의 피해회복 책임의 강화라는 3가지로 요약할 수 있을 것이다. 영국 제도의 시사점을 토대로 우리의 제도를 검토하면, 다음과 같은 제도 개선을 생각해 볼 수 있다. 먼저, 업무의 특성을 고려하여 통일적 기준설정이나 지원이 필요한 부분은 중앙부처에서 담당하되, 일반적인 피해자 보호·지원업무는 지방자치단체에 권한을 대폭 위임하는 것이 실질적 피해자 지원뿐만 아니라 자치단체의 책무성 강화에도 부합될 것으로 생각된다. 또한 피해자를 형사절차상 당사자에 준하는 지위로 격상시키기 위해서는 피해자의 절차참여권을 적극적으로 보장할 필요가 있다. 이 점에서 경찰에서 시행중인 범죄피해 평가제도의 법적 근거 마련 및 회복적 사법의 활성화는 앞으로 지속적으로 추진되어야 할 과제이다. 마지막으로 범죄 피해를 초래한 가해자의 피해회복 책임과 피해자보호기금의 재정 건전성 향상이라는 관점에서 향후 벌금의 일정 비율을 기금에 산입하는 방식을 재검토할 필요가 있을 것이다.
Abstract
In 2012, the Ministry of Justice published a consultation document ‘Getting it Right for Victims and Witnesses’ and it criticized that practical support for victims was not consistently available under the current system. In order to solve this problem, it proposed that Police and Crime Commissioners (PCCs) should be responsible for the commissioning process at a local level. Following the consultation process, from October 2014 PCCs become responsible for the commissioning of victim services. As a result of the PCCs’ responsibilities for the commissiong of victims’ services, a number of different models have subsequently been developed across England and Wales. In 2013, Victims’Code was also revised to transform the criminal justice system by putting victims first, making the system more responsive and easier to navigate. It sets a minimum standard for the services that must be provided to victims of crime by organisation in England and Wales. These reformed victim policies in England and Wales can be important references in the preparation of establishing a new action plan for protection and support for victims in Korea.
