기독교 윤리적 관점에서 본 이슬람의 정교분리(laïcité)의 의미 연구

본 연구는 종교법과 시민법이 이슬람법 안에 모두 혼용되어 있는 문제를 밝힌다. 그리고 종교법과 시민법의 분리가 오히려 종교에 자유를 보장한다고 제시하는 바이다. 현재 한국사회에서 이슬람은 테러리즘으로 그리고 모슬렘들을 테러리스트라는 인식하고 있다. 종교가 정치와 법과 하나가 되면서 ‘종교 전체주의’ 이념을 양산하기 때문이다. ‘종교 전체주의’에 반대하여 이슬람 민주주의에 대한 요구 상승으로 이슬람국가들 내부에서 종교와 정치를 분리하려는 개혁의 움직임이 있다. 본 연구는 세속화, 세계화, 정교분리(laïcité)의 측면에서 이슬람법을 통해 정교분리를 설명한다. 기독교 윤리적 관점에서 볼 때 이슬람교로부터 이슬람법의 분리는 인류문화에 평화와 공존에 이바지하는 것으로 볼 필요가 있다.
Abstract
This study addresses the issue of the intermingling of religious law and civil law within Islamic jurisprudence. It also posits that separating religious law and civil law guarantees greater religious freedom. Currently, in South Korean society, there is a perception of Islam primarily associated with terrorism, and Muslims are often stigmatized as terrorists. This perception is a result of the convergence of religion, politics, and law, leading to the ideology of 'religious totalitarianism.' In contrast to 'religious totalitarianism,' there is a growing demand for Islamic democracy, which has prompted reform movements within Islamic nations to separate religion and politics. This research explains the concept of secularization and the principle of separating religion from politics (laïcité) within Islamic law. From a Christian ethical perspective, the separation of Islamic law from Islam should be viewed as contributing to peace and coexistence in human culture.
