『정치학』 2권에서 아리스토텔레스는 플라톤의 『법률』 속 정체는 군주정의 요소는 전혀 없이, 민주정과 과두정의 결합을 보여줄 뿐이라고 비판한다. 이 논문은 아리스토텔레스의 이 같은 비판을 플라톤 특유의 혼합정체 이론과 결합된 법치론을 고찰하기 위한 탐구의 출발점으로 삼아, 아리스토텔레스가 간과하는 플라톤 정치이론 특유의 ‘군주정’ 요소가 『법률』의 전체를 지도하는 ‘법에 대한 절대적 복종’의 이념으로 작동하고 있음을 밝힌다. 플라톤에게 ‘군주정’은 왕, 혹은 그에 준하는 ‘한 사람’의 지도자라는 권력 형식이 정체에 제도적으로 수용되었다는 의미 보다는, 왕이라는 한 사람이 상징하는 ‘지식에 기반한 통치 능력’에 상응하는 능력이 법을 통해 국가에 최대한 구현된다는 의미를 갖는다. 플라톤 식 법치가 마그네시아의 구체적 입법에 구현되는 양상을 더 잘 알아보기 위해서 법치의 근원에 대한 플라톤의 탐색이 담긴 『정치가』 291-303의 분석을 함께 살펴본다. 플라톤이 『법률』에서 제시하는 공직에 관한 제도들과 ‘야간위원회’의 구성 및 활동 원칙 등은 모두, 지성에 근거한 훌륭한 법을 확보하여 그 법에 복종할 뿐 아니라, 주체적으로 보완하고 수정하며 운용할 수 있는 역량을 지속적으로 재생산하는 정치 공동체의 수립이라는 목적에 봉사한다. 하지만 논리적으로 신적인 지성의 지배와 직접적으로 연결되어 있는 플라톤 식 법의 지배는 궁극적으로 마그네시아의 법적 정당성에 대한 철학적 아이러니를 남겨 놓는다.
Abstract
This article takes a cue from Aristotle’s critique that there is no monarchical element mixed into the constitution of the Laws, and argues instead that we can identify the said monarchical element in the absolute authority of the laws that permeates the Magnesian life. The monarchical element we can identify in the Laws is not reducible to the institutional arrangements of particular political offices. It obtains rather in the principle that the supreme authority of the state is invested in the laws. The monarchical element, argued by the Athenian as a necessary element of the mixed constitution, requires the state maximally to approximate a kingly power of knowledge in the absence of an idealized perfect king, through the authority of well-legislated laws. Plato’s Statesman 291-303 provides an opportunity to look into Plato’s theory of laws to reassure that Plato justifies rule of law only on the condition that it is subject to the intellect of kingly statesmen. A survey of the Magnesian constitutional arrangements of the political power, including the Nocturnal Council, confirms that they meet the requirement of the Statesman’s conception of rule of law. The final philosophical legitimacy of the Magnesian laws, however, remains unconfirmed and left in ironical evasion.
