공유지 비극론의 재이해를 토대로 한 마을숲의 지속가능한 관리 -강릉 송림리 마을숲 사례에 대한 검토를 중심으로

마을숲은 자연적으로 생성된 것이 아니라 마을공동체가 그들의 필요에 의해 인공적으로 조성하고 마을 구성원들이 공동의 규칙과 규범을 마련하여 보호하고 유지․관리해 온 것이다. 마을숲은 경관적 기능, 환경·생태적 기능, 문화·휴양적 기능 등 다양한 기능을 수행하기 때문에 보전 가치가 높은 것으로 평가되고 있다. 공유지 비극론에 따르면 마을숲과 같은 공유지는 비극적 상황으로 귀결되거나 비극적 상황을 피하기 위해 사유재산권의 설정이나 국가권력의 강력한 개입이 필요하다. 한국의 마을숲은 오랜 기간 동안 건강하게 유지되어왔으나 갈수록 소유관계의 변화, 마을숲과 지역주민들의 관계 변화, 공동체의 붕괴, 공유지내 자산의 상품화를 자극하는 사회경제구조의 작동 등의 이유로 전국적으로 많은 마을숲들이 훼손되었거나 훼손될 위기에 처해 있다. 따라서 이 글에서는 마을숲의 사유화나 강력한 국가개입에 의해서가 아니라 마을숲의 공유성을 유지하는 것이 중요하며, 마을숲 보전이 당위적인 차원이 아니라 예전에 마을숲이 수행했던 기능이 지역에 따라 현재에도 여전히 의미가 있는지, 마을숲과 마을주민과의 관계에 대한 이해를 기초로 마을숲은 누가 어떤 목적으로 왜 어떻게 보존해야 하는지가 중요하다는 문제의식에서 마을숲의 지속가능한 관리 방안을 다룬다. 마을숲은 “장소에 기초한 접근”을 통해 마을숲의 필요성에 대한 마을주민들의 공통된 인식을 기초로 마을주민들의 삶과 마을숲의 가치를 엮어내고 마을숲이 주민들에게 편익을 제공하도록 관리하면서 참여를 이끌어 낼 때 공유성이 확보됨으로써 보전의 가능성이 높아짐을 확인하였다. “공유지의 비극”은 사유화를 통해 해결되기보다 오히려 공유자원이 공유되지 않고 사유화됨으로써 발생하는 것으로 공유지의 공유성을 유지하거나 회복하는 것이 무엇보다 중요하며 마을숲의 가치에 대한 지역주민의 인식과 참여가 기초가 되어야 한다.
Abstract
Most village forests have been damaged and are facing the risk of destruction in Korea. Since village forests have performed various functions in terms of Feng-shui, landscape, micro climate control, production, culture, and education, they seem to deserve conservation. According to the theory of the tragedy of the commons, the commons such as village forests cannot help resulting in tragic situation, forest villages in Korea have maintained nature of the commons for a long time. Since village forests are not nature itself but nature intentionally created by local communities to satisfy their needs, they have been conserved, maintained and managed based on communities' rules and norms. Currently, however, large part of village forests are facing the risk of destruction because of ownership change, change of relationship between village forests and local residents, breakdown of communities, operation of socio-economic structure oriented to commodification of common pool resources. Therefore, village forests conservation cannot be achieved justifiably based on the necessity of conservation. It is required to explore whether functions of village forest carried out in the past are still meaningful and who should be the subject of village forests conservation with what purpose. This paper finds that we need “place-based approach,” in which the value of village forests are recognized by village residents, lives of village residents' and the value of village forests are interconnected, and the existence of village forests provides benefits to village residents, especially based on village residents' participation in management process. If problems occur when village residents recognized the value of village forests but they do not own them, it is necessary to recover common ownership by engagement of state, local government or citizens' voluntary action. “The tragedy of the commons” occur because of private ownership of the commons. It is very important to maintain or recover common ownership of the commons and local residents' recognition of the value of the commons and their participation in management of the commons.
