Abstract
There are four specific reasons regulating minimal bank capital by the government. First, an adequate capital cushion can protect against bank runs by depositors who are afraid that a bank will be unable to repay its debts. Second, by requiring a certain ratio of capital to assets, governments think that the risk of systemic bank failures will be reduced. Third, a safe capital cushion will prevent taxpayers from bailing out the overall banking system in nations that have a deposit insurance scheme. Fourth, international capital adequacy standards will block the ace to the bottomproblem resulting from competition to over-leverage assets. When analyzing the capital adequacy law in detail, every one can find an interesting fact. Current capital adequacy law is the product of a unique form of legal process. Since bank capital is sure a subject for national regulation, capital adequacy law is enacted by the governments. No international treaties mandate the commercial banks of different nations to maintain a certain level of capital. Nor has the United Nations instituted any restrictions on commercial banksbalance sheets. Nonetheless, capital adequacy laws are factually identical all around the world. The Basle Committee on Banking Supervision (hereinafter he Basle Committee initiated this kind of internationalized national law. This paper examines the role, authority and international influence of the Basle Committee. The current Basle Accord of 1988 and the new Basle Accord of 2004 are the next parts considered in detail. After analyzing the main contents and the policy considerations behind both Accords, this paper highlights the fundamental flaws of the capital adequacy standards. Finally, this paper deals with the substantial influence of the new Basle Accord on the Korean banking industry and shows any political suggestions involved.
