무역보험도 일반 보험과 마찬가지로 보험의 특성 상 위험 관련 정보에 대해 보험계약자가 보험자 보다 우월한 정보를 갖게 되는 정보의 비대칭성으로 역선택이 발생할 수 있다. 역선택이 발생하게 되면 보험자의 재정은 악화되고 이는 결국 건전한 보험계약자의 손해로 이어지게 된다. 그동안 일반 보험시장에서의 역선택에 관한 연구는 많이 진행되어 왔으나 무역보험에서 역선택에 관한 연구는 거의 없는 상태이다. 특히 우리나라 무역보험제도와 성격이 유사하고 무역보험 활용률이 높은 일본의 무역보험 약관에 나타난 역선택 조항을 분석해 보는 것도 의미가 있다 할 것이다. 이에 문헌연구를 통해 일본에서 시행되고 있는 12가지 종류의 무역보험 약관 중 보험기간, 고지의무, 보험대위, 포괄보험제도 등 역선택과 관련된 조항들을 구체적으로 분석해 봄으로써 우리나라 무역보험 약관에 대한 시사점을 제시하는데 본 연구의 의의가 있다.
Abstract
This paper is a study on the adverse selection in Japanese trade insurance. The purpose of this paper is to analyse the clauses of adverse selection, and then to work out the solution about asymmetric information from adverse selection in trade insurance clauses. For this purpose, especially this paper explains theoretically the adverse selection. Also this paper analyse term of insurance, commencement date, duty of disclosure, subrogation, package policy in Japanese trade insurance clauses. The problems created by adverse selection are an important impediment to well functioning trade insurance, so insurance market failure occurs because of those problems. In conclusion, for the economically corresponding schems of the problems from adverse selection, authority and insurer should plan and manage some solutions such as norm or system to mitigate the problems of adverse selection, collateral, monitoring and enforcement of restrictive covenants etc. To maintain a long term growth in trade insurance market, the insurer needs to make continuous efforts discouraging adverse selection by the means of minimizing information asymmetry and reviewing the insurance incentive.
