한국과 일본의 단기수출보험 약관 비교를 통한 개선점 연구

Abstract

Japan started providing trade insurance to its exporters 20 years in advance of Korea. This paper is to seek ways to improve K-sure's General Terms and Conditions by comparing those of K-sure's to NEXI's. Comparing General Terms and Conditions on Short-term Credit Insurance of K-sure and NEXI, each the main operator of Korea's and Japan's trade insurance, the conclusions are that General Terms and Conditions of K-sure's are more advantageous to its policy holders : Allowing Korean exporters to ship goods withstanding 30 days of payment delay, running provisional payment systems, and shortening time limit for indemnification. Furthermore, K-sure's policy of preferential treatment toward small and middle sized exporters is outstanding, noticing that small and middle sized exporters are being provided with higher percentage of provisional payment and generous Waiting Period. On the other hand, there are lots to be improved in K-sure's General Terms and Conditions through benchmarking NEXI's General Terms and Conditions. First, NEXI had drastically streamlined a number of more than 50 General Terms and Conditions in 1980s. Likewise, it seems that K-sure needs to streamline and modify its current 43 General Terms and Conditions. Second, through this modification process, K-sure needs to reduce policy holders' confusion in interpreting potentially controversial Credit Risks in General Terms and Conditions, by providing more specific standards, and this can be done by studying NEXI's General Terms and Conditions. Third, it seems that K-sure also needs to increase transparency in the coverage of its insurance, which can be done by providing clients with clear explanation that NEXI does not cover non-payment risen from claimed goods or preparing specific standards for indemnification. Lastly, K-sure can help its policy holders, many who are in need of legal knowledge, better understand its General Terms and Conditions by clarifying limitation on claim and computation of the starting point of the claim period.
