흔히 계약론은 동물에게 도덕적인 권리를 부여하지 않는다고 생각된다. 합리적이지 못한 동물은 가상의 계약에 직접 참여할 수 없으므로 자신에게 도덕적 권리를 부여하는 합의를 이끌어낼 수 없기 때문이다. 이 점에서는 롤스의 정의 이론도 마찬가지 입장을 보인다. 그는 도덕적 인격만이 원초적 입장의 계약에 참여할 수 있다고 주장하기 때문이다. 이 글은 롤스의 정의 이론에서 동물이 정의의 영역에 포함된다는 것을 보이는 데 목적이 있다. 롤스가 공정한 합의를 위해 타고난 우연적인 성질들을 무지의 베일로 가릴 때, 인종이나 성별뿐만 아니라 종도 가려져야 하는 성질이라고 해야 일관적이기 때문이다.
Abstract
Contractarianism is believed not to give moral rights to animals, because irrational animals cannot participate in hypothetical contract in behalf of them. Rawls contends similarly that only moral person can participate in the contract in original position, excluding animals who are not qualified as moral person. In this paper, I show that animals are included in the realm of Rawls’s theory of justice. He can and should consistently make thick the veil of ignorance for participants in original position not to know their species as well as sex and race.
