이 글은 적절하게 이해된 케이건식의 종차별주의, 즉 양상인격주의(modal personism)는 쉽게 편견으로 치부될 만한 입장이 아니며 얼마든지 철학적으로 진지하게 고려할 만한 입장이라고 주장한다. 특히 케이건식으로 이해한 종차별주의는 동물권 옹호론자들이 종차별주의가 가지는 결정적 비판이라고 여겼던 비판들 – 즉, 가장자리 상황 논증, 그리고 종차별주의와 성차별, 인종차별의 유사성 논증 –로부터 공격당하지 않는다는 것을 보인다. 또한 이러한 양상인격주의의 핵심적인 몇몇 아이디어는 거슬러 올라가면 아리스토텔레스에서 유래함을 지적하고 인간을 ‘정치적 동물’로 이해하는 아리스토텔레스의 규정이 동물권 논쟁에 가지는 함의를 설명한다. 동물권 옹호론자들의 전략은 기본적으로 인권개념을 확장하는 것이라는 점에 주의를 환기시키고 인권의 철학적 기반에 대한 논의가 동물권, 그리고 종차별주의 논쟁에 가지는 연관성을 지적한다. 마지막으로 동물권 논쟁의 촉발과 그로 인한 우리 사회의 변화가 인간의 “진정한 이타주의”의 가능성을 보여준다는 것을 지적하고 종차별주의에 대한 동물권 옹호론자들의 비판이 아이러니하게도 인간이 독특하게 가지는 자기비판 능력 발현의 훌륭한 예라는 점을 지적한다.
Abstract
I argue in this paper that speciesism, if properly construed, is not a mere prejudice but a view that needs to be taken philosophically seriously. I show that Kagan’s modal personism, which I take to be a sophisticated version of speciesism, is immune from the two criticisms considered final by animal rights advocates, that is, the argument from marginal cases and the argument from analogy between speciesism on the one hand and sexism and racism on the other. I also point out that some central ideas behind Kagan’s modal personism can be traced back to Aristotle and explain important implications of Aristotle’s understanding of human beings as “political animals” on animal rights debate. Seeing that animal rights are viewed as extension of human rights, I discuss the implication that the question of the philosophical foundation of human rights have on the animal rights debate. I claim at the end that the animal rights debate presents a good example of the possibility of human beings being “really altruistic,” thereby ironically showing the morally significant difference between humans and non-human animals.
