반려견의 항공운송서비스에 관한 정책적 고찰- 기내 반입 반려견을 중심으로 -

최근 1인 가구의 증가 및 반려동물 사육이 유행하여, 반려동물 보유 가구 비율은 전체 가구의 28.1%로 2012년 이후 지속적으로 증가하고 있으며, 우리나라의 전체가구 4가구 중 1가구는 반려동물을 기르는 것으로 나타났다. 그러나 반려동물 수의 급속한 성장에 비해, 관련 제도나 에티켓 수준은 아직 미흡한 것으로 보인다. 관련 법규범 및 제도의 성장이 뒷받침되지 못하여 반려인(伴侶人)과 비(非)반려인과의 갈등이 발생할 것으로 예상된다. 특히 반려동물과 함께 여행을 하려고 하는 과정에서 운송 수단 내에서 발생하는 문제가 지속적으로 증가할 것으로 예상된다. ICAO, IATA, EU 협약 등 해외 관련 법규범을 연구한 결과, 이동이 제한되는 교통약자의 이동을 도와주는 신체 보조견에 관한 규정은 존재하지만, 반려동물 관리 규정은 상당히 미흡한 것을 알 수 있었다. 우리나라의 관련 법규범도 이와 마찬가지로 반려동물에 관한 규정은 아직 미약한 수준이었다. 이러한 와중에 올해 2018년 1월 24일 김포-제주행 아시아나 항공편에서 기내 반입 반려견에서 비롯한 문제로 항공기 출발이 2시간이나 지연되는 사건이 발생하였다. 항공사 자체규정으로 기내 반입 반려동물을 통제할 수 있지만, 자체 규정이나 운송약관은 해당 승객에게 반려견 반입으로 발생할 수 있는 문제를 처벌할 권한은 없다. 이러한 문제점을 인지하여, 더불어민주당 윤관석 의원은 “… 반려동물의 종류․무게, 운송 방법, 승객 준수 사항 등을 포함한 항공기내 반려동물 반입 기준을 정해 고시해야 한다…”고 주장했다. 이러한 주장에 힘입어, 현재 항공기내 반려동물 반입과 관련된 국내 법규범 및 각 항공사의 자체규정을 연구하고, 참조할 수 있는 해외 법규범 비교를 통해 현실적인 개선방안을 제시하고자 한다.
Abstract
With the recent increase in single-person households and the growing popularity of pets, the proportion of pet-holding households has steadily increased to 28.1 percent of the total households since 2012. All the furniture in our country, one out of four have been raising pet animals. However, relative to the rapid growth of the number of pets, the level of related institutions and rituals seems to be still low. The lack of support for the growth of relevant legal and institutional systems is expected to create conflicts between pet owner and non-pet owner. In particular, in the process of traveling with pets, problems in transport are expected to continue to increase. Studies of international law codes such as ICAO, IATA and EU treaties show that the provisions for body-assisted dogs that help limit movement of vulnerable transporters are fairly feeble compared to the existing ones. Korea’s law system, likewise, still had a weak regulations on pets. In the meantime, the departure of the aircraft was delayed for two hours due to problems, including in-flight carry-on flights at Gimpo-Jeju Asiana Airlines on January 24, 2018. Airline's own terms and conditions allow the control of in-flight pets, in-house regulations or terms and condtions of transport are not authorized to punish any problems that may arise from the return of pets to the passengers concerned. Recognizing these problems, Rep. Yoon Kwan-seok of the DubuleoMinju Party said, Criteria for the carry-in of pets, including the type of pets, transportation method, and passenger compliance, should be established and reported. On the back of this argument, we would like to present realistic provisions by comparing domestic and international law-enforcement authorities related to the current carry-over of pets in aircraft and each airline’s own rules.
