This study reviewed the infertile couple support policy in the aspects of the right to birth and health of women, and analyzed the dilemma. In the analytical process, the relationship among the government power, medical power, and the women’s right to birth was examined in order to suggest a practical solution to securing a right to healthy birth. In Korea, the infertility policy was introduced as the response by the government to the low birth-rate crisis and to the demand of right to birth for infertile women. Consequently, the support policy for infertile couples has lessened somewhat the burden of medical costs for infertile couples, but limited the right to birth and infringed the right to health. It becomes a dilemma that infertile women often want the support on medical costs for their right to birth despite infringed right to health and limited right to birth. The burden of medical costs for infertile couples appears to be an obstacle to the right to birth and even acting as a factor for giving up their own health rights. Therefore, to guarantee the right to healthy birth, the publicity of a maternal instinct should be secured by bringing full support on the medical cost or by applying the medical insurance.
