Abstract
The classification of historical documents is essential for their collection and organization. The classification methods employed by two major institutions specializing in the collection and management of historical records in Korea — Jangseogak at the Academy of Korean Studies and the Kyujanggak Institute for Korean Studies at Seoul National University — are considered prominent standards in current use. Jangseogak primarily employs a content-based classification system, while Kyujanggak relies on formal criteria as its foundation. This distinction should serve only as a broad framework because neither approach alone can construct a comprehensive categorization system. The Kyujanggak approach begins with the clear formal criterion, that is, the document issuers, Yet, at more detailed levels, classification inevitably depends on contents, where it becomes challenging to identify consistent criteria. Conversely, Jangseogak organizes documents initially by content, but this method also encounters difficulties due to unclear criteria and often ambiguous boundaries between categories. Recently, various institutions have amassed a substantial collection of historical documents, making it imperative to develop more systematic classification frameworks to enhance their utility. The critical questions are what criteria should be used and how they should be applied. This study proposes a categorization method based on the legal effects intended by juristic acts. Legal documents are here defined as documents that embody the expression of intent to achieve specific legal effects among private entities. For instance, documents could be classified based on whether they pertain to inheritance or contracts, and again contracts could further be divided into subcategories, such as sales, gifts, or other types. Establishing clear definitions of these concepts can provide a robust foundation for classification. As a test of it, this study classifies historical documents based on the understanding of the modern concept, “gift.” The unilateral nature of gift contracts, where only one party bears an obligation, is also evident in the distinct format of gift-related documents. These documents distinctly specified a justifiable reason for the transfer of property to only one side or for the cogent cause for the exclusion of other potential inheritors. This contrasts with sales documents, which commonly might include mere generic explanations, such as “due to necessary expenses.” Here, gift-related documents from the Joseon Dynasty have been categorized by refining their conceptual distinctions while reflecting the trends and achievements of prior research. First, clear criteria were established to define types of “records of family property division” (분재기, 分財記), as the terms associated with these records had often deviated from their intended meanings and were even used interchangeably. In this study, “Bungit” (분깃, 分衿) was aligned with the unilateral act of bequest, and definituinb of”Hwahoe” (화회, 和會) associated with the division of inherited property. Documents corresponding to gift contracts were identified as”Byeolgeub” (별급, 別給) and”Heoyeo” (허여, 許與), with the distinction between the two based on whether the recipient was a direct descendant or another relative. Gifts made to non-family members were categorized as”Gisang” (기상, 記上) and”Heonnap” (헌납, 獻納). The former refers to property donated by a childless slave to their master under the law, which was often exploited as a tool for illegal gains. The latter is comparable to modern donations to corporations or foundations. As outlined above, the classification of gift-related documents into four categories Byeolgeub, Heoyeo, Gisang, and Heonnap documents, is based on the nature of the recipient. Additionally, the first two categories pertain to familial transfers, reflecting a characteristic of “passing down” property, while the latter two involve transactions outside familial relationships, conveying an aspect of “offering.” The process of examining and establishing classification systems for historical documents not only enhances their utility but also fosters an interactive improvement in the depth of understanding achieved during this process.
