동물보호법상 동물의 범위에 관한 일고

초록

이 논문에서는 동물보호법 제2조 제1호와 동법 시행령 제2조에 대한 해석론을 전개하고, 그러한 해석론이 동물의 보호와 복지에 적절한 것인지 비판적으로 검토하여 보았다. 현재 동물보호법상 동물의 정의규정은 ① 쾌고감수성을 중요하게 다루었다는 점에서 높이 평가할 만 하지만 ② 보호대상이 척추동물에 한정되는 점 ③ 식용을 목적으로 하는 파충류･양서류･어류 등은 동물보호법의 적용대상에서 제외되는데 과연 ‘식용을 목적’으로 한다는 것이 어떤 의미인지 불분명할 뿐 아니라 이를 동물 정의의 소극적 요건으로 사용하는 것이 적절한 지 의문이라는 점 등은 개선이 필요하다고 보인다. 그리고 ④ 현재의 동물보호법상 동물의 기준이 법률에 규정되어 있어 자연계 연구 성과를 즉시 반영하기 어려운 점이 있으므로 쾌고감수성의 보유라는 조건 이외에 동물의 범위에 관한 다른 요건들은 시행령이나 시행규칙에 과감히 위임하는 것이 적절하다는 의견도 덧붙여 보았다. 이 때 행정부가 별다른 기준 없이 임의로 동물의 보호 범위를 정하지 못하게 하기 위하여 자문 내지 감시기구를 설치하는 것도 고려될 필요가 있다.

Abstract

This paper aims to develop an interpretation theory for Article 2, Item 1 of the Animal Protection Act and Article 2 of the Enforcement Decree of the same Act, and critically investigated whether such an interpretation is appropriate for animal protection and welfare. When it comes to the regulations to define animals under the current Animal Protection Act, ① it deserves high praise in that sentience was treated as an important factor. However, it seems that improvements are needed in the following: ② The subject of protection is limited to vertebrates ③ Reptiles, amphibians, fish, etc. with edible purpose are not subject to the Animal Protection Act. However, not only is it unclear what the ‘edible purpose’ means, but it is questionable whether it is appropriate to use it as a passive requirement to define an animal. Additionally, ④ animals are defined under the current Animal Protection Act, so it is difficult to immediately reflect the performance of research in the natural world. Therefore, it seems appropriate to boldly delegate other requirements to fall into the scope of animals other than the condition of sentience to enforcement ordinance or enforcement rules. In such a case, it seems that it is necessary to consider establishing an advisory or monitoring organization to prevent the administration from arbitrarily establishing the scope of protection for animals without any specific standards.
