EU 난민망명 수용과 통제를 위한 거버넌스 연구-독일과 이탈리아 사례연구와 관련하여

초록

유럽연합 난민망명의 관리는 정치, 경제, 사회의 사안 및 안보를 우선한 회원국의 제한적 수용정책 선호와 유럽연합 차원의 정책 실행과의 간극이라는 이중적인 구조와 모순을 띠고 있으며, 초국적이고 단일화된 정책 운영은 한계를 띠고 있다. 최소의 공통기준lowest common denominator정책에서 공동유럽의 정책으로 전향을 시도한 망명시스템 운영의 효율성에 대한 논란이 지속되고 있고 공동화된 망명정책의 이행의 적절성과 부작용의 논의는 회원국과 유럽연합의 협력의 미비함을 지적한다. 일련의 조약과정에서 망명정책은 정책이행의 법적근거를 마련하고 난민신청방법 및 절차에 대한 유럽적 기준 설정의 성과를 내기도 하였지만, 한편 정책이행을 위한 유럽연합 기구인 이사회 및 의회의 역할배분의 비대칭성, 회원국의 국가선호와 재량권 유지와 같은 한계를 내포하기도 하였다. 또한, 유럽연합의 공동 이민망명정책은 난민망명의 접근을 제한하기 위한 제 3 국가와의 협력체제 방안인 외연화 채택에 의해 비적절성이 제기된다. 난민망명 유입은 초국가적 사안으로, 그 문제의 해결은 유럽연합 혹은 회원국 어느 한쪽으로 편향된 정책선호와 입장 견지로 이루어 질 수 없으며, 유럽연합과 회원국의 공동협력에 의해 가능한 것이다. 한편, 파니존은 난민망명의 사안에 대한 유럽연합과 회원국의 대처와 관련해 유럽연합이 지향하는 인권과 시민권 보장을 위한 자유, 정의, 안전 영역의 유지 가능성에 대한 회의적 전망을 나타낸다. 외부국경통제와 강제적 추방 및 구금 등은 난민망명유입에 대한 근본적인 대처방안이 아니며, 유럽연합의 핵심가치를 저해하는 것이다. 최근, 난민수용에 대해 관대한 국내정책을 펼친 스웨덴조차도 난민에 대한 부담감으로 인해 대다수의 난민을 추방하는 조치를 취하였고, 대규모 난민유입을 허락한 독일에서도 난민들이 환영받지 못하는 대상이 되었다. 더욱이, 2015년 11월 파리, 2017년 8월 바르셀로나와 카탈루니아에서 발생한 연쇄테러에 의해 국경통제 강화 및 난민유입 차단의 목소리가 높아지는 상황에서 극단적인 난민혐오를 내세운 극우정당의 정치지지 확보는 공동체적 난민망명관리 이행을 위한 또 다른 변수로 작용할 수 있다. 실질적으로 독일의 대안당, 이탈리아의 동맹당, 프랑스의 민족전선등의 극우정당들은 반이민정책의 강경화를 주요 정책아젠다로 채택하면서 유권자들에게 정치적 지지를 호소하며 입지를 강화하고 있다. 이는 난민망명정책의 공동체화의 과정에서 회원국의 편의와 선호를 우선하고 근본적으로 난민망명 유입을 차단하여 난민수용의 책임을 전가하는 요인으로 작용할 수 있다. 또한 다양성속의 통일성을 지향하는 유럽통합 공동체 가치의 희석가능성도 간과할 수 없다. 정치, 사회, 경제 전반에 점증하는 반이민, 반민족, 반유럽의 유럽회의론의 확산은 통합의 지속가능성의 여부에 의문을 제기하는 것이다. 난민망명관리가 유럽연합 통합의 핵심 사안으로 제기되는 만큼, 유럽차원의 공동조치의 방안이 시급히 마련되어야 하며, 회원국과의 공조와 협력이 강화된 거버넌스의 방안이 모색되어야 할 것이다.

Abstract

This article focuses on the specific type policy problem for the control of refugee in the EU, and it discusses the necessity of enhancement of multi-level governance system in practicing of policy making of asylum and refugees. Although we can notice the adaptation of multi-level governing strategy in various policy areas of the EU, it might suggest a question of asylum and refugee policy making on which the national government‘s competence might be limited. In fact, even though it has been expected that the upgrading of the European Commission and European Parliament’s role for the asylum process after EU’s major treaties, this has not been occurred. And as the national preference would be prominent on policy making decision, the practice of multi-level governance has not been activated well in this policy area. In this paper, it examines the practicable conditions in multi-level governing for asylum and refugee policy, analysing the case study of policy making of asylum and refugee in Italy and Germany.
