인권친화적 집시법 개정을 위한 제언- 제21대 국회 입법안에 대한 비판적 평가를 중심으로 -

제21대 국회에서 다수의 집시법 개정안들이 발의되었음에도 불구하고 단 한 건도 실제 법률 개정으로 이어지지 못했다. 이렇게 된 데에는 여러 가지 원인들이 있겠지만, 집시법 개정안을 마련하면서 집시법 전반을 관통하는 패러다임에 대한 근본적인 고민이나 해결방안 마련에 골몰하기보다 특정 시점에서 이슈화된 현실 상황에 대한 단기적인 처방을 현행 법률에 대입시키는 데 더 천착하지는 않았을지 의구심이 든다. 집시법 제정 이후 60여 년이 지나는 동안 많은 개정이 이루어졌지만, 평화적 집회를 보호·촉진하는 데 주안점을 두기보다는 주로 ‘적법-위법’ 패러다임에 따른 규제 대상으로 집회·시위를 바라보았다는 한계를 지니고 있다. 또한 2000년대에 들어서면서 이루어진 집시법 개정도 적지 않은 부분에서 헌법재판소의 결정이나 법원의 입장을 소극적으로 반영하는 데 그쳤다는 비판도 가능하다. 이러한 배경 하에 본고에서는 최근 임기가 종료된 제21대 국회 집시법 개정안의 주요 쟁점들을 비판적으로 분석·평가하였다. 또한 이를 통해 제22대 국회에서 더욱 인권친화적인 집시법 개정이 이루어질 수 있도록 그 입법 방향 역시 제시하고 있다. 그간 규제일변도의 집회·시위 입법정책이나 대응기조가 집회·시위를 관리·통제해 왔던 국가 당국과 이를 개최하고 그에 참가했던 시민들 모두에게 이른바 ‘win-win’의 효과를 발산시켜왔다고 단언할 수 없다면, 이제는 우리 사회 구성원들의 폭넓은 참여하에 이들의 의사가 최대한 반영된 집시법 개정안이 마련되어야 할 시점에 와 있다.
Abstract
Although a number of amendments to the Assembly and Demonstration Act were proposed in the 21st National Assembly, not a single one led to actual amendments to the law. There may be a variety of reasons for this, but in preparing the amendment to the above Act, rather than focusing on fundamental concerns about the paradigm that penetrates the entire law on assembly and demonstration or preparing solutions, it raises doubts whether it simply applied short-term solutions to specific issues that were highlighted at certain points in time. Although many amendments have been made in the last 60 years after the enactment of the above Act, the limitation is that assemblies and demonstrations were mainly viewed as objects of regulation according to the 'legal-illegal' paradigm rather than focusing on protecting and promoting peaceful assembly. In addition, it can be criticized that the revision of the above Act in the 2000s merely passively reflected the decisions of the Constitutional Court or the court's position in many aspects. Against this background, this paper critically analyzed and evaluated the major issues in the amendments to the above Act of the 21st National Assembly, whose term of office recently ended. In addition, through this, the legislative direction is also presented so that the 22nd National Assembly can revise the above Act to be more human rights-friendly. If it cannot be said with certainty that the regulation-oriented legislative policy or response to assemblies and demonstrations has had a so-called 'win-win' effect on both the state authorities who have managed and controlled assemblies and demonstrations and the citizens who have held them and participated in them. We are now at a point where an amendment to the above Act must be prepared with the broad participation of members of our society and to reflect their opinions as much as possible.
